-52-

City Attorney Goodrich reviewed State Statute regarding adoption of a Comprehensive Plan. As
it pertains to the March 28, 2001 draft the City did conduct a public hearing as required and the
Statute does not state that every word in the Comprehensive Plan is subject to a public hearing.
If the text has been changed significantly then another public hearing should be held. The
question is, is the language changing a significant change.

Mayor Gamec inquired if it was the City Attorney's opinion that the Rural Preserve Area
language and the Septic System ordinance can be submitted to the Met Council with the March
28, 2001 draft.

City Attorney Goodrich replied that one of the general topics haS always been sewer and for .that
reason he felt that language and the septic system ordinance could be submitted to the Met
Council. ,_~¢~
Councilmember Kurak st~2 .~LT. ~
~:. ....that ~he language changes to the central Rural Preserve Area took
out things that resid~t~ were cond~ed about. A simficant point WaS that the
area would not be developed for ~e¢~:;-~ar~'; and felt that the wording should be subject to a
public heahng. ~ ~ ....

Councilmember ~derson inquired ai~¢Sh~¢~e c~traints or penalties are for not adopting the
Comprehensive Plan in ~ne months. ":~/ ~

Principal Pla~er Tmdgeon replied that undek St~t~,TStamte':~ties ~e required to adopt a
comprehensive pl~ rune monks a~er rece~vmg::~et G6gnc~l approval, ~f the C~W does not
comply with that requirement they would be in violation ofZ~}ate St~te.

Councilmember ~derson inquked if ~e aliment policy wo~td~e f~b play.

CiW Administrator No,an replied that it could.

Councilmember Hendriksen stated that he did not think that the Met Council could take grants
away from the City, but they could impact future scores.

City Attorney Goodrich noted that the Met Council would have the authority to get a court order
to order the City to adopt a Comprehensive Plan.

Motion by Mayor Gamec, seconded by Councilmember Kurak, to approve and adopt the
Comprehensive Plan approved by the Met Council on March 28, 2001, contingent upon the
language for the Central Rural Preserve Area being approved as well by the Met Council.

City Council/December 11, 2001

I
I
I
I
I
I
I
I
I'
I
I
I
I
I
I
I
I
I
