City Administrator Norman replied that Mr. Hendriksen is trying to skew what is before them.
Staff is recommending that they continue changing the language through the amendment
process.

Councilmember Hendriksen stated that a big issue was made about the protections of the area in
the Central Planning Area and now they are suggesting that the Council adopt a Plan that does
not include the amended language.

Mayor Gamec stated that they would be submitting the Rural Preserve Area language, the Land
Use Map, and Sewer ordinance after the public hearing in January 2002.

Councilmember Hendriksen stated that the Council could approve the March 2001 plan and then
the Met Council could refuse~the amendments and then the City has given the residents a false
assurance. ~,~5? ~; ~:~

Mayor Gamec stated;~'t the lan~e change regarding the Rural Preserve Area was made by a
vote of the City counc~!, and it ~?sen~,:,[o the Met council so it would stand unless the Council

C~W Attorney Goodrich ~nqmr~::as to'~hat t~;Met Counml had done w~th that lan~age.

CiW Administrator No.an replied ~fi~t the Met Co~cil has stated that ~ey will consider ~e
language as pa~ of the amendment

Councilmember Kurak inquired if they coul~
Preserve Area amendment being included.

City Attorney Goodrich replied that the
contingent on the Met Council accepting the Rural

Plan with the Rural

the Comprehensive Plan
e.

Councilmember Kurak replied that she could agree with that.

Councilmember Hendriksen stated that the City has a publ!c hearing on the Rural
Preserve Area language. When the language was voted on to be sent to the Met Council he chose
to abstain from the vote because his greatest concern was that it was a parliamentary tactic that
would not come forward. His concern was that the ultimate plan would not include the Rural
Preserve Area language. If the Council accepts the March 28, 2001 draft it will not include the
language and if they include the language as part of the approval then the Council will be
adopting something without a public hearing on that language.

Mayor Gamec inquired if they could include the Rural Preserve Area language and the Septic
System Ordinance as part of the March 28, 2001 plan.

City Council/December 11, 2001

-51-
