-86-

Community Development Assistant Wald replied that staff has had a couple of conversations
with Lord of Life regarding the issue and they have stated that they are okay with the proposed
location, but brought forward other options as a point of discussion.

City Engineer Jankowski noted that the street grades, as proposed, do meet well between the two
properties.

Councilmember Zimmerman inquired if the City will have' access to the private street that will be
on the Lord of Life property.

Community Development Director Frolik replied that' the City will be granted a public access
easement.

Councilmember Kurak expr~-g~d;concern with the proposed "wishbone" street because of the
possible accessibility reS~Ction~¢ifor safety equipment, and the limited visibility by patrol
officers. Her sugg~on would b~iJto eliminate that road and readjust the location of those
townhomes, so that theistreet was;~aig~eped.

Director of Public Works/Fire Clffef:Kaple~-;~eplied that if the parking scheme is followed as
presented there should not be~sroBf~rn wi~:getting emergency equipment into the site. He
stated that he has more of a co'cern wi~:{h~-:'Sharp angle mm on the opposite side of the road.
Corey Lepper, .Orrin Thompson Ho~"s, expt &h the first design for the site started with
what Ms. Kurak proposed with strai~i4t'~ihgl out?~e first street, but a problem was created
because then all of the driveways were awkwai:~l})(~¢': ~;~k.: .

Councilmember Kurak inquired if it would be~'p6ssibl~;:tbT..:,straig~ten out Cobalt Street.

Mr. Lepper rephed that Cobalt S~eet w~ desired that way because~,}hey wanted to buffer the
units from T.H. ~47 ~d the existing neighborhood and still leave ro~:~.'~ a p~k.

Mayor Gamec stated that they would be be~er off with w~as proposed rather than having
numerous ~gled driveways.

Councilmember Zimmerman stated that if the Fire Chief can give input to make sure that safety
equipment-can access the units then most of his major concerns would be,resolved:

Councilmember Hendriksen stated that in a previous case they saw that all of the instances where
they approved a deviation from City Code it was used to set precedent 'for passing something that
was not allowed. Currently private drives are not permitted in the City, and if they allow them in
this case they will be setting precedent. He questioned as to why the roads cannot be constructed
to comply with City Code.

City Council/December 18, 2001

I
I
I
I
I
I
I
I
i
!
I
I
I
I
I
I
I
I
I
