-22- <br /> <br />Public Hearing <br /> <br />Acting Chairperson Johnson called the public hearing back to order at 7:14 p.m. <br /> <br />Presentation <br /> <br />Ms. Frolik stated that Ms. Dahlheimer is requesting a conditional use permit to maintain a total <br />of four horses on her 2.5 acres plus~the 4 acres she rents. The subject property is located at 8820 <br />181st Avenue and the applicant is renting property located at 8840 18Ist Avenue. The applicant <br />moved to the City of Ramsey in 1984 and has been maintaining horses on the property ever <br />since. The surrounding parcels range in size from 2.5 acres to approximately 10 acres and most <br />property owners in the area own horses. Greg Matuseski has submitted a letter stating that he is <br />indeed renting four, plus or minus, acres to the Dahlheimers and does not currently own any <br />horses on his ten-acre parcel. The applicant has stated that the manure produced by the horses is <br />dispersed to surrounding neighbors and spread on the subject property. City Code requires barns <br />to be set back a distance of 50 feet from dwellings and 75 feet from property lines. The 2.5 acre <br />parcel contains a 30 foot by 55 foot (1,650 square feet) barn that is located approximately 64 feet <br />from the nearest property line. The applicant has a round pen area for the horses on the 2.5 acre <br />parcel. The Horse Care Board met on January 17, 2001 to review the request for a conditional <br />use permit. The Horse Care Board and staff recommended approval of the conditional use <br />permit contingent upon the applicant providing verification that four acres is being leased from <br />Mr. Matuseski (the adjacent neighbor) and the permit specifying that if the lease between the <br />Dahlheimers and Mr. Matuseski is terminated, the applicant will remove two horses from the <br />property to comply with City Code restriction of two horses on parcels 1.5 to 3 acres in Size with <br />a conditional use permit. The Horse Care Board and staff also recommended that the conditional <br />use permit include language that this approval does not set a precedent in allowing leased land to <br />count as acreage towards the number of permitted horses a property owner can have.
