I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br /> <br />Ms. Dahlheimer replied that they use the manure on their garden and the neighbors use it on their <br />gardens as well as on the neighbor's field. <br /> <br />Acting Chairperson Johnson inquired if the applicant had an oppommity to review the conditions <br />of the permit. <br /> <br />Ms. Dahlheimer replied yes. <br /> <br />Motion by Acting Chairperson Johnson, seconded by Commissioner Watson, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Acting Chairperson Johnson, Commissioners Watson, Reeve, and <br />Wivoda. Voting No: None. Absent: Chairperson Nixt and Commissioner Kociscak. <br /> <br />The public heating closed at 7:21 p.m. <br /> <br />Commission Business <br /> <br />Acting Chairperson Johnson called the regular meeting of the Planning Commission back to <br />order at 7:21 p.m. <br /> <br />Acting Chairperson Johnson stated that it seems that there have been horses on the property for <br />16 years and having looked at the conditional use permit, it seems reasonable. <br /> <br />Motion by Acting Chairperson Johnson, seconded by Commissioner Wivoda, to recommend that <br />City Council adopt Findings of Fact relating to a request from Theresa Dahlheimer for a <br />conditional use permit to maintain four horses on property that includes 2.5 acres of owned <br />property and four acres of leased land. <br /> <br />Further discussion: Commissioner Watson stated that the use seems consistent with the existing <br />neighborhood. Commissioner Wivoda inquired as to what the rules are pertaining to ieased land. <br />Community Development Director Frolik explained that City Code does not specify that leased <br />property can be taken into consideration when calculating the number of permitted horses. <br />Commissioner Watson inquired if there was an opportunity to add leased property into the <br />ordinance. Community Development Director Frolik recommended having the Horse Care <br />Board review the issue. Consensus of the Commission was to have the Horse Care Board <br />consider the issue. <br /> <br />Motion Carried. Voting Yes: Acting Chairperson Johnson, Commissioners Wivoda, Reeve, and <br />Watson. Voting No: None. Absent: Chairperson Nixt and Commissioner Kociscak. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Wivoda, to recommend that City <br />Council approve the Conditional Use Permit request from Theresa Dahlheimer to maintain four <br /> <br />Planning Commission/February 6, 2001 <br /> Page 7 of 10 <br /> <br />-23- <br /> <br /> <br />
