WHEREAS, the property owner of the Subject Property has been identified by the City as <br />follows: <br /> <br />T & G Land Inc. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOIC'4. COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That in order to carry out the purposes and objectives described above it is necessary to acquire <br />the Subject Property. <br /> <br />o <br /> <br />That the acquisition of the Subject Property by exercise of eminent domain in the manner <br />provided by Minnesota Statute Chapter 117 serves a public interest and is deemed to be <br />necessary. <br /> <br />That the City deems it necessary for the reasons set forth above to proceed without delay under <br />Minn. Stat. §117.042 to pay to the owners or into court a sum of money to serve as <br />compensation to the owners of the Subject Property, which amount shall be equal to <br />Petitioner's approved appraisal of value as determined by the City. <br /> <br />4.. <br /> <br />That the City Administrator is hereby directed to acquire the Subject Property in accordance <br />with Minnesota Statutes. The City Administrator is authorized to negotiate and represent the <br />City of Ramsey in all proceedings. <br /> <br />That if the Subject Property cannot be acquired by direct negotiation, it shall be acquired by <br />eminent domain. <br /> <br />That the City Council hereby authorizes acquisition of the Subject Property by eminent domain <br />and to take title and possession of that land prior to filing of an award by the Court Appointed <br />Commissioners pursuant to Minn. Stat. § 1.17.011 and §117.042. <br /> <br />That the City Attorney is attthorized to file the necessary petition therefore, and to prosecute <br />such action to a successful conclusion or until it is abandoned, dismissed or terminated by the <br />City or Court. <br /> <br />That the City Administrator is authorized to expend necessary funds for appraisals of Subject <br />Property. <br /> <br />The motion tbr the adoption of the foregoing resolution was duly seconded by Councilmember __ <br /> And upon vote being taken thereon, the following voted in favor <br />thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />-212- <br /> <br /> <br />
