Stat. §469. [24 further declares that the actions to assist the implementation <br />of the above development programs authorized b~; said statute are a public purpose and that the <br />execution and financing of these programs are a public purpose; and <br /> <br /> WHEREAS, the City, pursuant to Minn. Stat. §469.126, has the author/ty to acquire land by <br />eminent domain within its Development Distr/cts; and <br /> <br /> WHEREAS, the City has authority to acquire real property for public purposes by eminent <br />domain pursuant to Minn. Stat. Chapter 117 and pursuant to its City Charter; and <br /> <br /> WHEREAS, the City has the fight to acquire the real property prior to the filing of an award <br />by the Court appointed commissioners, pursuant to Minn. Stat. § 117.011 and §117.042; and <br /> <br /> WHEREAS, the City finds and declares that it is in the public interest to acquire title to and <br />possession of the real property pr/or to the filing of an award by the court appointed commissioners; <br />and <br /> <br /> WHEREAS, the real property which needs to be acquired for the industrial park purposes <br />described above is legally described as follows <br /> <br />That part of Lot 1, Auditors Subdivision Number 30, described as follows: <br />Commencing at a point on the east line of said Lot a distance 1,295 feet south of the <br />northeast comer thereof; thence north 67° 47' west a distance of 712.89 feet; thence <br />north and parallel to the east line of said Lot 1 a distance of 419.09 feet; thence north <br />89° 27' west a distance of 308.19 feet; thence due north a distance of 150 feet; thence <br />north 88° 05' 35" west a distance of 307.50 feet; thence south along the westerly right- <br />of-way of Sunfish Lake Boulevard a distance of 807.43 feet to the point o[' beginning, <br />all in Anoka County, Minnesota, subject to easements of record (one of which is 66 t~oot <br />wide(N/S) by 307.50 foot long (E/W) driveway easement over the north 66 feet of the <br />east 307.50 feet of the subject property in favor of the City of Ramsey); <br /> <br />(The ~'Subject Property:); and <br /> <br />WHEREAS, the Anoka County PiN's for the various parcels are as follows: <br /> <br />34-32-25-11-0018; <br />34-32-25-11-0019; and <br />34-32-25-I 1-0023 <br /> <br />-211- <br /> <br /> <br />
