I

I
I
I
I
I
I
I
!1

CASE # ~'-"

REQUEST FOR A GR_4,DING PEPe¥IIT TO GRADE AND EX_PORT SOILS;
CASE OF NORTH FORK, INC.
By: City, Engineer Steve Jankowski and
Community Development Director Sylvia Frolik

Background:

On April 28, 1987, the City issued a grading permit to L&G Rehbein and North Fork, Inc. to grade
and excavate a lake in the Northfork P.U.D. Subsequent to the issuance of that permit, the City
Code pertaining to grading and mining permits was amended. In April of 1991, the permit was
reissued in accordance with the revised regulations. In August of 1991, that permit was transferred
from L&G Rehbein to Glenn Rehbein. The permit issued to Glenn Rehbein had an expiration date
of July 31, 1992. The permit lapsed and in November of' 1995, the City issued a new permit to
complete excavation of the lake area and create walkout style home sites. That permit expired on
February 28, 1999, prior to the exporting of the materials. '

Notification:

State law requires notification of the public hearing to all properties within 350 feet of the subject
property. Staff notified all properties within 500 feet of the subject property.

Observations:

I
I
I
i
I

North Fork, Inc. has applied for a reissuance of a grading permit to construct a second lake and
create some walkout style building sites in the area of the proposed plat of St. Andrews Addition in
the Northfork Planned Unit Development (PUD).

The grading plan proposes to export approximately 300,000 yards of sand from the 80 acre site.
This is a reduction from the 800,000 yard proposed in previous applications. The Applicant has
stated that the reduction in materials to be export is a result of decreasing the size of the lake and
not trying to make all of the lots full walkouts.

There are several potential destinations for the exported materials: a) a project in Elk River; b)
City of Rarnsey street improvement project to extend 153rd Avenue N.W. east of Armstrong Blvd.
N.W.; c) the relocation site for T&G Land in the proposed Gateway Industrial Park 5; c) a Bury &
Carlson project. (It was reported at the Planning Commission that the fill may also be used for in
the outlot south of 153~a but it has been determined that the fill for that site will come from excess
soils southeast of Lake Itasca.)

The Planning Commission conducted a public hearing regarding the request on January 2. There
was one resident present expressing concern with project size, erosion control, and administration of
the permit.

Subsequent to the Planning Commission meeting, the developer supplied the City with a phasing
plan for the grading operations. The grading is proposed to be accomplished in accordance with the
13 sub-areas identified on the 2-phase plat development plan (Sheet C3A) prepared by Ulteig
Engineers, Inc. and dated 1/12/01.

-95-
