Or upon recording, St. Andrews Addition, Anoka County, Minnesota (the "Subject Propem7") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COIJNCIL OF THE CITY OF tL~kMSEY, ANOKA COUNTY, STATE OF MLN~'ESOTA that the findings of fact relating to the request are determined to be as follows: That on April 28, 1987, a permit was issued to L&G Rehbein, Inc. and North Fork, Inc. for the grading and excavating of a lake in the Northfork P.U.D. That the permit issued in 1987 had no set expiration date and subsequent to its issuance, the City of Ramsey amended its grading and mining regulations. 3. That on April 23, I991, the City, of Ramsey reissued the 1987 permit in accordance with the revised grading and mining regulations. o That on August 13, 1991, the City of Ramsey approved transferring the grading and mining permit from L&G Rehbein, Inc. to Glenn Rehbein, Inc. That the permit issued to Glenn Rehbein, Inc. in 1991 contained an expiration date of July 31, 1992. That on October 26, 1995, the City of Ramsey received an application from North Fork, Inc., hereinafter referred to as "Applicant", for the reissuance of a permit to exports soils associated with the completion of the lake excavation and revised lot grades for the creation of walk-out sites. 7. That the permit issued in 1995 contained an expiration date of February 28, 1999; the material was never exported and the permit has lapsed. 8. That on December 14, 2000, the City of Ramsey received a new application to wade and export soils from the Subject Property. That the Applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on January 2, 2001, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. ~ U / 10. That the Subject Property is located in a ~olf co rse. residential area of a Plan_ned Unit Development and the proposed area for grading is approximately eighty (80) acres in size.
