11. That Section 9.11.18 (Grading, Mining and Filling Permits) states that a permit shall be <br /> required to grade individual lots by more than .3 feet in depth, fill individual lots by more <br /> than 2 feet at any point, and excavate more than 400 cubic yards of earth material. This <br /> Section also states that permits shall be issued for a maximum 3 year period. <br /> <br />12 'hat the grading plan submitted proposes to export approximately 300,000 yards of sand. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />22. <br /> <br />23. <br /> <br />24. <br /> <br />25. <br /> <br />That the Applicant has stated that there is a potential for the exported materials to be directed <br />to several destinations: a project in Elk PAver, other areas of the Northfork P.U.D., City of <br />Ramsey street improvement project to extend 153'd Avenue N.W. east of Armstrong Blvd. <br /> <br />That no blasting will be employed in the grading or excavation activity. <br /> <br />That no excavation will take place within the road fight-of-way. <br /> <br />That the existing drainage patterns will not be substantially altered by the proposed grading <br />plan. , <br /> <br />That the grading and excavation operation will increase the traffic to the subject property, for <br />an extended period of time, but on an intermittent rather than continuous basis. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br />That the proposed use will not substantially adversely impair the use, enjoyment, or market <br />value of any surrounding property. <br /> <br />That the proposed use will not be hazardous or disturbing to existing or future neighboring <br />uses. <br /> <br />That the proposed use will be a substantial improvement to property in the immediate <br />vicinity and to the community as a whole. <br /> <br />That the proposed use will be served adequately by public facilities and services such as <br />highways and streets. . <br /> <br />That the proposed use will not create excessive additional requirements at public cost for <br />public facilities and services, and it will not be detrimental to the economic welfare of the <br />community. <br /> <br />That the proposed use will not involve uses, activities, processes, materials, and equipment <br />and conciitions of operation that will be detrimental to any persons, property, or the general <br />welfare by reason of excessive production of traffic noise, smoke, fumes, glare, or odors. <br /> <br />That subsequent to the 1/02/01 Planning Commission meeting, the Applicant submitted a <br />Preliminary Grading Plan prepared by Ulteig Engineers, Inc., dated 1/12/01 that identifies a <br />13 phase grading operation , <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Cotmcilmember <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />-107- <br /> <br /> <br />
