_Councitmember moved for the adoption of the following findings of fact: -158- RESOLUTION #00-12- (PC 00-022) A RESOLUTION ADOPTING FINDINGS OF FACT # REQUEST FOR A CONDITIONAL USE PERMIT FOR A TELECOMM-UNICATION TOWER. RELATING TO A 175-FOOT MONOPOLE WHEREAS, American Tower Corporation, hereinafter referred to as "Applicant", has properly applied for a Conditional Use Permit to construct, install and operate a monopole telecommunication ("Tower") on the property generally known as 14165 Ramsey Blvd. NW and legally described as follows: All that part of west 31 rods of southwest quarter of southwest quarter of Section 27, Township 32, Range 25, Anoka County, Minnesota, described as follows: Commencing at a point on the west line thereof a distance 335.51 feet south from the northwest comer thereof as measured along said west line, thence south along said west line a distance of 335.51 feet more or less to its intersection with northerly right of way line of Northern Pacific Railway, thence southeasterly along said northerly right of way line to its intersection with east line of said west 31 rods, thence north along said east line thereof a distance of 448.92 feet more or less to a point on said east line thereof a distance 448.92 feet south from the northeast comer of said west 31 rods as measured along said east line thereof, thence north~vesterly in a straight line to the point of beginning. Except Parcel 2, Anoka County Highway Right of Way Plat #16 (the "S ubj ect Property"). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Applicant appeared before the Planning Commission for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code on December 5, 2000, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. That the Subject Property is located in the B..W Business Warehouse district, is approximately 4.68 acres in size, and is owned by Bruce Volk. o That the Applicant is proposing to Iease a 10,244 square foot space of the Subject Property (Site) to facilitate the development and operation of the Tower. That the property to the north, east and west are zoned BW Business Warehouse, the parcels to the south are zoned B-3 Highway Business, and the Subject Property is bounded by Burlington Northern Rail Road tracks to the south. That City Code restricts tower heights in the Business Warehouse (Industrial) districts to 175 feet.
