_Councitmember moved for the adoption of the following findings of fact: <br /> <br />-158- <br /> <br />RESOLUTION #00-12- <br />(PC 00-022) <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A <br />TELECOMM-UNICATION TOWER. <br /> <br /> RELATING TO A <br />175-FOOT MONOPOLE <br /> <br /> WHEREAS, American Tower Corporation, hereinafter referred to as "Applicant", has <br />properly applied for a Conditional Use Permit to construct, install and operate a monopole <br />telecommunication ("Tower") on the property generally known as 14165 Ramsey Blvd. NW and <br />legally described as follows: <br /> <br />All that part of west 31 rods of southwest quarter of southwest quarter of Section <br />27, Township 32, Range 25, Anoka County, Minnesota, described as follows: <br /> <br />Commencing at a point on the west line thereof a distance 335.51 feet south from <br />the northwest comer thereof as measured along said west line, thence south along <br />said west line a distance of 335.51 feet more or less to its intersection with <br />northerly right of way line of Northern Pacific Railway, thence southeasterly <br />along said northerly right of way line to its intersection with east line of said west <br />31 rods, thence north along said east line thereof a distance of 448.92 feet more or <br />less to a point on said east line thereof a distance 448.92 feet south from the <br />northeast comer of said west 31 rods as measured along said east line thereof, <br />thence north~vesterly in a straight line to the point of beginning. <br /> <br />Except Parcel 2, Anoka County Highway Right of Way Plat #16 <br />(the "S ubj ect Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the Ramsey City Code on December 5, 2000, and that said <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br /> <br />That the Subject Property is located in the B..W Business Warehouse district, is <br />approximately 4.68 acres in size, and is owned by Bruce Volk. <br /> <br />o <br /> <br />That the Applicant is proposing to Iease a 10,244 square foot space of the Subject <br />Property (Site) to facilitate the development and operation of the Tower. <br /> <br />That the property to the north, east and west are zoned BW Business Warehouse, the <br />parcels to the south are zoned B-3 Highway Business, and the Subject Property is bounded <br />by Burlington Northern Rail Road tracks to the south. <br /> <br />That City Code restricts tower heights in the Business Warehouse (Industrial) districts to <br />175 feet. <br /> <br /> <br />
