I I I I I I I I I I I I I I I I I i Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #00-12- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT FOR THE CONSTRUCTION AND OPERATION OF A 175-FOOT MONOPOLE TELECOMMUNICATIONTOWER AND DECLARING TERMS OF SAME WHEREAS, American Tower Corporation, has properly applied for a conditional use permit to construct and operate a 175-foot monop01e telecommunication tower on a 10,244 square feet leased section (Site) of the property generally known as 14165 Ramsey Blvd. NW and legally described as follows: All that part of west 31 rods of southwest quarter of southwest quarter of Section 27, Township 32, Range 25, Anoka County, MinneSota, described as follows': Commencing at a point on the west line thereof a distance 335.51 feet south from the northwest comer thereof as measured along said west line, thence south along said west line a distance of 335.51 feet more or less to its intersection with northerly right of way line of Ndrthem Pacific Railway, thence southeasterly along said northerly right of way line to its intersection with east line of said west 31 rods, thence north along said east line thereof a distance of 448.92 feet more or less to a point on said east line thereof a distance 448.92 feet south from the northeast comer of said west 31 rods as measured along said east line thereof, thence northwesterly in a straight line to the point of beginning. Except Parcel 2, Anoka County Highway Right of Way Plat #16 ("Subject Property"). WHEREAS, the Planning Commission met on December 5, 2000, conducted the public hearing and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact # , a conditional use permit for a 175 foot monopole tower and related equipment building is hereby granted to American Tower Corporation ("Permittee") and Brace Volk ("Property Owner"). This permit is perpetual in its duration so long as the terms imposed herein are complied with. The development of the Site shall be in accordance with Sheets SS 1, SS1, and SS3 (Site Plan, Site Elevation, Landscaping Plan) prepared by Terra Resources, Ltd. dated January 4, 2001. The chain link security fence shall be installed and maintained in accordance with the approved site plan to prevent unauthorized entry to the tower. -161-
