I <br />I <br />I <br />I <br />I <br /> I <br /> I <br />I) <br /> <br />Proposed Charter Amendment <br /> Chapter 5 - INITIAl, REFERENDLqVl AND RECALL <br /> <br />Section 5. t Powers Re~erved by the People The Citizens of Ramsey reserve to themselves the power of initiative, Referendum and Recall The <br />power of Initiative shall apply to any action permitted by law. Referendum shall apply to any action taken or considered by the Ramsey City <br />council. The power of Recall shall apply to elected officials. <br /> <br />Section 5.2 General Provisions for Petitions. The provisions for initiative, Referendum and Recall shall follow the process and requirements set <br />forth in state law for amending the charter. The city may not place limitations or impose additional requirements, or restrictions that are not <br />required to amend the city charter except aa may be mandated by state law. II'requested by the chairperson of the dreulating committee, the city <br />shall review a petition for compliance with proper petition format as set forttt in state law for amending the charter. <br /> <br />Section 5.3 Scheduling of Election. Unless found to be manifestly unconstitutional, the city council shall schedule an election to decide the <br />question posed by initiative, referendum or recall, upon receipt of a petition found to comply with the format set forth in state law for amending the <br />charter, and which has hean signed by a sufficient, number of voters. <br /> <br />S~2tion 5,4 Initiative to Amend the Charter. Nothing in this chapter shall be construed in any way as affecting the right oftlte electors to <br />propose amendments to this charter. <br /> <br />Sectiou 5.5 Enforceability and Effective Date~ This amendment shall replace sections 5,1 through 5.8 o~'the Ramsey city charter and become <br />effective at 12:01 AM of the day following mtitication by the citizens of Ramsey. If any provision of this chapter is found to be unenforceable for <br />any reason the remaining portion shall apply to the fullest extent possible. <br /> <br />S~ction 5.6 Obligation to Uphold Changes. The city shall be required to implement all actions proposed under this chapter, which, have been <br />approved by the voters.
