I <br />:1 <br />I <br /> I <br /> I <br /> <br />'1 <br /> I <br /> I <br /> I <br /> <br />I <br />I <br />i <br />I <br />! <br />I <br />I <br />I <br />I <br /> <br />REPORT FROM PUBLIC WORKS COMMITTEE <br /> By: Public Works Staff <br /> <br />CASE #: <br /> <br />Background: <br /> <br />The Public Works Committee met on Tuesday, February 20, 2001 and discussed the <br />following five cases: <br /> <br />Case #1: Request for Consideration from North Lake Properties, Inc. <br /> <br />Mr. Wayne Johnson was present. Two separate issues were discussed. First was whether <br />it was proper to collect the storm water impact fee at the time of the site plan <br />development, as has been the City policy since implementing Resolution #97-06-165. <br />The second issue involved whether the City should reimburse Mr. Johnson for the <br />removal of a water service that was stubbed out, but was not utilized since a larger size <br />was required for his development. <br /> <br />The Committee was directed to receive a legal opinion from the City Attorney on the <br />wording of the resolution to determine whether it would limit the collection of the storm <br />water impact fee to the time of platting only. The Committee also 'requested a legal <br />opinion on the service removal and directed staff to research the policies of other <br />communities regarding this issue. <br /> <br />Council Action: <br /> <br />Motion to ratify the direction of the Committee. <br /> <br />Case #2: Consider Correspondence from Ellen Stanley <br /> <br />Mrs. Stanley requested that the Council take the initiative in initiating a feasibility study <br />for the extension of municipal services into Pondvale Estates. She indicated that the <br />residents not wishing to connect to the City services could opt out through the City <br />Charter. Funding for the unconnected properties might possibly come through a state <br />grant. <br /> <br />The Committee suggested that grant funds for this purpose seemed unlikely. Members of <br />the Committee also suggested that the requirement to pay assessments upon sale of the <br />property could be considered an objectionable imposition on their property.
