10. 11. 12. STOILMWATER MANAGEMENT FEE. The CITY has enacted a Stormwater Management Fee in the amount of Three Thousand Six Hundred Fifty Eight Dollars ($3,658.00) per commercial acre. The Site size for stormwater management calculation purposes will not include the area occupied by the stormwater detention pond. The amount of Stormwater Management Fee due on the Site is Seven Thousand Nine Hundred Seventy Four Dollars and no cents ($7,974.00) (2.18 acres x $3,658/acre). A cash payment will be required prior to the CITY releasing the Building Permit. FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of these items on the Site shall be as directed by the City's Fire Chief. LIGHTING. Any lighting installed on the structure or in the parking lot is subject to the prior approval of the City Engineer and shall be designed so as to deflect light away from T.H. #47 and the service road. Bulbs emitting in excess of 3,000 lumens (I50 watts) shall be so directed that the bulb is not visible from off of the property where such light source is located , BUILDING FACADE. The Permit-tee agrees to face the Structure with a combination of rock face block, face br/ck, stucco, and pre-cast concrete stone ledges in accordance with the Exterior Elevations prepared by Lampert Architects, dated April 13, 2000, revision date May 2, 2000, issue date June 15, 2000. REQUIREMENTS FOR BUILDING PERMIT AND CERTIFICATE OF OCCUPANCY. No building permit for. the Site will be issued until the permittee has: a) signed and returned this Development Permit; b) provided the required cxsh payment for trunk sewer and water services in accordance with Item #6 of this Permit; c) provided the required cash payment for stormwater management in accordance with Item #6 of this Permit; and d) provided the required financial guarantee in accordance with Item #12 of this Permit. No Certificate of Occupancy for the structure will be issued until the Required Improvements. are. accepted by the City and the landscaping maintenance guarantee has been provided in accordance with Item #13 of this Development Permit. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements shall be completed before December 31, 2000. ESCROW FOR REQUIRED IMPROVEMENTS. In order to insure the installation of the Required Improvements in accordance with City specifications and in a timely manner, the Permit-tee shall be required to deposit with the City a cash escrow or letter of credit, approved as to form by the City, in the mount of Eighty Seven Thousand Dollars and no cents ($87,000.00), which is 150% of the City's estimated cost of the Improvements.
