By: ADOPT RESOLUTION APPROVING APPRAISAL FOR ACQUISITION OF MPCA PARCEL OF LAND William IC Goodrich, City Attorney Background: The City Council by Resolution 98-11-287 authorized the commencement of an eminent domain action for acquisition of a parcel of land owned by the Minnesota pollution Control Agency ("MPCA"). The purpose of the acquistion ias for wetland mitigation purposes. The parcel in question is triangle shaped and is .917 acres in size. As a part of that condemnation process an appraisal has been completed. The appraiser has determined the value of the MPCA parcel to be $2700.00. This then is the amount which the City will need to offer the MPCA for title to the parcel. The land owner has the option of accepting the appraisal amount or going forward with the condemnation process includ/ng commissioners hearings as well as a District Court trial. The final amount paid to the parcel owner could therefore be more than the $2700.00 if so determined by the commissioners and/or District Court Judge. In th/s case, the MPCA has informally indicated that it is willing to accept the appraisal amount and requires the condemnation action only for its procedural purposes. In order for the City to acquire title to the parcel now we must deposit the $2700.00 with the District Court or pay it to the owner at the owner's discretion. This deposit cannot be made until the Council approves the appraisal amount. Enclosure: Proposed resolution approving appraisal amount. Copy of survey of the parcel to be acquired. Recommendation: Staffrecommends that the council adopt Resolution 01-03- which is a resolution approving the appraisal amount of $2700.00 for the .917 acre 1VfPCA parcel.
