Councilmember Hendriksen inquired if it would make sense to approve site plan conting~nt-up0n resolving the access issue at a later date. City Engineer Jankowski stated that staff could put together the costs of relocafia~ S'iir}fish Lake Court and bring them back for Council review. Councilmember Anderson inquired if the buildings proposed by Mr.,Sharp"~'~id be built in same location regardless of the location of the access. Mr. Sharp stated that he is concerned about the economics o£~Oving the street.. Mayor Gamec stated that he would prefer the Coun~i~ommendafib:':.over moving Sunfish Lake Court. Councilmember Zimmerman stated that the cost of movin~ ..the':~tilities alone would cost thousands of dollars. City'-Administrator Norman state that at the February 27, 2001 City Council meeting, the Council {ntroduced an ordinance to permit the sale of the City owned property at the intersection ofT.H. #47'and>,the soon to:b~ built Sunwood Drive extension. This is approximately 11.2 acres which is the sfiSject of the'~ebruary 18, 1999 purchase agreement between the City and ACCAP. ACCAP has commenced a lawsuit seeking specific performance of the purchase agreement and/or damages.from the City. Staff recommended adoption of the ordinance together wi_th._a motion to auth0iSze the City Administrator and the Mayor to execute the necessary documents to close this tranSaction pursuant to the terms of the February 18, 1999 purchase agreement.
