-170- <br /> <br />Councilmember Hendriksen inquired if the development complies with the Charter Amendment <br />or not. · - <br /> <br />City Attorndy Goodrich stated that there needs to be some finding as to how the Charter <br />implications were addressed in the development. <br /> <br />Councilmember Hendriksen inquired as to how the Council can justify saying that one developer <br />has to follow the Charter and the other does not. <br /> <br />City Attorney'Goodrich replied that the CounciI will be subjecting themselves to criticism if they <br />do not follow the Charter. <br /> <br />Mayor Gamec suggested staff draft £mdings addressing the Charter issues. <br /> <br />community Development Director Frolik noted that the City would have to invoke the 60 day <br />extension. <br /> <br />City. Attorney Goodrich stated, that the Plann/ng Commission Chairman who has been involved <br />with the Charter did approve the preliminary plat and suggested talking to him as to why he felt <br />the plat was acceptable.. <br /> <br />Community Development Director Frolik replied that the approval may have to do with the <br />proposed Density Transition Ordinance because the ordinance was going to grandfather all <br />property that was already zoned multi-family residential prior to its adoption. <br /> <br />City Attorney Goodriah recommended that the plat be sent back to the Planning Commission <br />since the Density Transition Ordinance was not adopted. <br /> <br />Councilmember ~knders~n stated that .the alternative to the proposed development would be <br />single family homes around the perimeter of the property and an apartment building in the center. <br /> <br />Motion by Councilmember Henddksen, seconded by Councilmember Zimmerman, to invoke the <br />60 day extension to comply with the zoning requirements and flush out traffic generation <br />analysis with the deficiencies and return to the Planning Commission with the notation that the <br />density transition ordinance has failed and.request that they make a recommendation based on <br />that'fact and adding to the plat the extension of Cobalt Street to 153rd Avenue and combining <br />Outlot A'with the Rademacher property. <br /> <br />Further discuss;,.on: Councilmember Anderson noted that this is a situation where the <br />Density Transition Ordinance is not feasible. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Kurak.
