That the DEVELOPERS will develop the Plat in accordance with <br />the City Code, Section 9.50, entitled "Subdivision" <br /> <br />Conformance with Plan. The Plat shall be developed pursuant to the final plat consisting <br />of one sheet (1) sheet, prepared by Swenson Land Surveying. <br /> <br />Incorporation of All City Code Requirements. That the recitals above and the provisions <br />of the City Charter, Subdivision Code, Zoning Code and Public Improvement Code of the <br />CITY as amended to date hereof, are incorporated herein by reference. <br /> <br />Dumpin~ of Garbage. The DEVELOPERS shall adhere to all City ordinances relating to, <br />but not limited to, dumping of garbage, site development, construction debris, open burning, <br />etc. <br /> <br /> II. <br />PERMITS AND OCCUPANCY: <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in the <br />Plat shall be issued until: (a) a Certificate of Survey, including that information required by <br />the CITY, has been supplied to the City Building Official; and (b) all the financial <br />guarantees required by the CITY have been satisfied. <br /> <br />Municipal Sewer. No Certificate of Occupancy for any dwelling constructed on any of the <br />lots in the Plat will be issued until the City's municipal sewer system is available for service <br />to the lots as determined by the City Engineer. <br /> <br /> III. <br />FEES AND CHARGES: <br /> <br />Park Dedication. Park dedication shall be satisfied by the DEVELOPER making a cash <br />contribution, in the amount of One Thousand Three Hundred Dollars ($1,300.00) for each <br />new lot created. Lot 1, -the existing homestead, and Outlot A are exempt from this fee. <br /> <br />Park Trail Development Fee. The DEVELOPER shall pay a trail development fee in the <br />amount of Three Hundred Twenty Five Dollars and no cents ($3250.00) per lot. Lot 1, the <br />existing homestead, and Outlot A are exempt from this fee. <br /> <br />-121- <br /> <br /> <br />
