-128- <br /> <br />The Planning Commission reviewed the rezoning request at their January 2, 2001 meeting. There <br />was no citizen input during the public hearing. <br /> <br />The City Council reviewed the rezoning request on January 23,2001. The Council referred the <br />case to the Public Works Committee in order to resolve a storm drainage easement issue that <br />would cross the Pehlke property. During the Public Works Committee, Staff proposed a more <br />comprehensive approach to storm drainage issues in the neighborhood as well as other <br />infrastructure issues that would be affected by future development. Staff worked closely with the <br />Pehlke's and determined that more discussion would be necessary prior to resolving all the issues <br />in the neighborhood, however, it was further agreed that the rezoning and plat process proceed. <br />The Pehlke's have agreed to sign a Letter of Understanding, which states that the Pehlke's will <br />continue to negotiate with the City to allow a water drainage easement on their property. <br /> <br />Recommendation: <br /> <br />Once a comprehensive plan has been adopted or amended, cities must conform their land use <br />regulations in accordance with the plan. The property has been in the MUSA since 1995 and <br />City Staff and Planning Commission recommend approval of rezoning the property fi:om R-1 <br />Rural Residential to R-1 Urban Residential. <br /> <br />Council Action: <br /> <br />Motion to adopt Resolution #01-04~ adopting Findings of Fact # relating to a <br />request fi:om Dave and Betty Pehlke to rezone certain properties fi:om R-1 Rural Residential to <br />R-I Urban Residential. <br /> <br />Motion to approve the rezoning request and introduce an ordinance to rezone the Pehlke property <br />from R-1 Rural Residential to R-1 Urban:Residential. <br /> <br />Motion to deny the request for rezoning from Dave and Betty Pehlke, based on the Findings of <br />Fact. <br /> <br />Review Checklist: <br />Community Development Director <br />City Attorney <br /> <br />CC: 04/24/01 <br /> <br /> <br />
