I <br /> I <br /> I <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br /> <br /> WHEREAS, City Code Section 9.50.50 defines "Stage I" Improvements and "Stage II" <br />Improvements which respective definitions are used herein when reference is made to "Stage I" <br />and "Stage II" Improvements. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES <br /> <br />1. City Code Compliance. That the DEVELOPER will develop the Plat in accordance <br />with the applicable provisions of City Code, Section 9.50, entitled "Subdivision". <br /> <br />2. Conformance with Plan. The Plat shall be developed pursuant to the final plat for <br />Sunfish Commons consisting of one sheet prepared by <br /> <br />3. Compliance with City Code. That the recitals above and the applicable provisi'ons of <br />the City Charter, Subdivision Code, Zoning Code and Public Improvement Code of the CITY as <br />amended to date hereof, are incorporated herein by reference. <br /> <br />4. Stage I Improvements. Stage I Improvements shall consist of sanitary sewer, municipal <br />water, and storm sewer. The installation of these Improvements shall be established as a term of <br />the Development Permit entered into with the CITY for the development of the property <br />subsequent to obtaining site plan approval from the City Council. <br /> <br />5. Access From Trunk Highway #10. The DEVELOPER herein agrees that right-of- <br />access along T.H. #10 adjacent to the subject property (with the exception of points of access as <br />granted by the State of Minnesota) shall be dedicated to the State of Minnesota <br /> <br />6. Pedestrian/Bicyclist Path. The DEVELOPER agrees to construct, in accordance with <br />City standards, an eight (8) foot wide bituminous pedestrian/bicyclist path, not to exceed 5% in <br />grade nor 2% cross sectional, parallel to Sunfish Lake Blvd. The. DEVELOPER shall also <br />provide approved turf establishment in conjunction with the path construction within the subject <br />Plat similar to that which is approved for the building site. The construction plans for said paths <br />are subject to the prior approval of the City Engineer. <br /> <br />7. Stormwater Management Fee. The City has enacted a Stormwater Management Fee <br />and the current rate is Three Thousand Seven Hundred Forty One Dollars ($3,741.00) per <br />commercial acre. The amount of Stormwater Management Fee due on the 3.8-acre parcel is <br />fourteen thousapd two hundred fifteen dollars ($14,215). A cash payment will be required prior <br />to the City releasing the Final Plat for recording.. <br /> <br />8. Sewer and Water Trunk Fees. Sewer and water trunk charge fees in the amount of <br />$28,530 shall be paid prior to the City releasing the final plat for recording. These fees represent <br />the remaining balance due to the City the sewer and water trunk charges. <br /> <br />-~53- <br /> <br /> <br />
