I I I I I I I I I I I I I WHEREAS, City Code Section 9.50.50 defines "Stage I" Improvements and "Stage II" Improvements which respective definitions are used herein when reference is made to "Stage I" and "Stage II" Improvements. NOW, THEREFORE, the CITY and DEVELOPER agree as follows: STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES 1. City Code Compliance. That the DEVELOPER will develop the Plat in accordance with the applicable provisions of City Code, Section 9.50, entitled "Subdivision". 2. Conformance with Plan. The Plat shall be developed pursuant to the final plat for Sunfish Commons consisting of one sheet prepared by 3. Compliance with City Code. That the recitals above and the applicable provisi'ons of the City Charter, Subdivision Code, Zoning Code and Public Improvement Code of the CITY as amended to date hereof, are incorporated herein by reference. 4. Stage I Improvements. Stage I Improvements shall consist of sanitary sewer, municipal water, and storm sewer. The installation of these Improvements shall be established as a term of the Development Permit entered into with the CITY for the development of the property subsequent to obtaining site plan approval from the City Council. 5. Access From Trunk Highway #10. The DEVELOPER herein agrees that right-of- access along T.H. #10 adjacent to the subject property (with the exception of points of access as granted by the State of Minnesota) shall be dedicated to the State of Minnesota 6. Pedestrian/Bicyclist Path. The DEVELOPER agrees to construct, in accordance with City standards, an eight (8) foot wide bituminous pedestrian/bicyclist path, not to exceed 5% in grade nor 2% cross sectional, parallel to Sunfish Lake Blvd. The. DEVELOPER shall also provide approved turf establishment in conjunction with the path construction within the subject Plat similar to that which is approved for the building site. The construction plans for said paths are subject to the prior approval of the City Engineer. 7. Stormwater Management Fee. The City has enacted a Stormwater Management Fee and the current rate is Three Thousand Seven Hundred Forty One Dollars ($3,741.00) per commercial acre. The amount of Stormwater Management Fee due on the 3.8-acre parcel is fourteen thousapd two hundred fifteen dollars ($14,215). A cash payment will be required prior to the City releasing the Final Plat for recording.. 8. Sewer and Water Trunk Fees. Sewer and water trunk charge fees in the amount of $28,530 shall be paid prior to the City releasing the final plat for recording. These fees represent the remaining balance due to the City the sewer and water trunk charges. -~53-
