-152- <br /> <br /> SUNFISH PROPERTIES <br /> DEVELOPMENT AGREEMENT <br />CITY OF RAMSEY, ANOKA COUNTY, MINNESOTA <br /> <br /> THIS AGREEMENT, made and entered into by and betweezi the CITY OF RAMSEY, <br />a municipal corporation of the State of Minnesota (the "CITY"), and SUNFISH <br />PROPERTIES, LLC, whose address is 10734 Hanson Blvd., Coon Rapids, MN 55433 (the <br />"DEVELOPER"). <br /> <br />WlTNESSETH: <br /> <br /> WHEREAS, the DEVELOPER is the fee owners of the following described property <br />situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described ' <br />as follows: <br /> <br />That part of east half of Government Lot 4, Section 34, Township 32, Range 25, <br />Anoka County, Minnesota. Lying southerly of southerly right of way line of <br />Burlington Northern Railroad and lying northerly of northerly right of way line of <br />Trunk Highway #10, except that part thereof lying west of following described line: <br /> <br />Commencing at intersection of west line of said east half with southerly right of way <br />line of said Burlington Northern Railroad thence southeasterly along said railroad <br />fight of way line 75.12 feet to point of beginning of said line, thence southerly <br />427.52 feet +or- to intersection with northerly right of way line of said Trunk <br />Highway #10 68.87 feet, as measured along said northerly right of way line, <br />southeasterly of point of intersection with west line of said east half and said line <br />there terminating, AKA part of Lot 11 Auditor's Subdivision No. 30, except road, <br />subject to easement of record. <br /> <br />Or after recording of the Sunfish Commons plat; <br /> <br />Lot 1, Block 1, Sunfish Commons <br /> <br />("Subject Property"); and <br /> <br /> WHEREAS, on ~ pursuant to Resolution No.01-04- , <br />the CITY has ~pproved the final plat of the Subject Property which plat is known as SUNFISH <br />COMMONS (the "Plat"), which approval is contingent on certain requirements, including the <br />DEVELOPER and CITY entering into this Agreement; and <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until the City Code escrow <br />requirements have been completed by the DEVELOPER; and <br /> <br />I <br />I <br /> <br />! <br />I <br />I <br /> <br /> <br />
