-238- Councilmember introduced the following resolution and moved for its adoption: #01-04- RESOLUTION AUTHORIZING CONSTRUCTION OF WELL NO. WATER SOURCE PURPOSES ACQUISTION OF PROPERTY FOR THE 3 AND RELATED FACILITIES FOR PUBLIC WHEREAS, the City finds it necessary and in the public interest to construct an additional municipal water well and well house to serve the water needs of the City's residents, which is to be known as Well House No. 3 ("Public Improvement Project"); and WHEREAS, the Public Improvement Project is identified on the City's master municipal water plan; and WHEREAS, the actual well has already been constructed on the Subject Property described below, however, the City has been unable to negotiate acquisition of fee title to the Subject Property; and WHEREAS, the legal description of the property necessary to acquire including the well site and access thereto is as follows: The ;vest 60.00 feet together with the south 230.00 feet of the west 215.00 feet of the Southwest Quarter of the Northeast Quarter of Section 28, Township 32, Range 25, Anoka County, Minnesota. ConsiSting of 2.46 acres more or less; (the "Subject Property"); and WHERAS, the City declares that it is in the public interest to acquire fee title to the Subject Property; and WHEREAS, the City has authority to acquire the Subject Property for the Public Improvement Project by eminent domain pursuant to Minn. Stat. Chapter 117; and WHEREAS, the City has the fight to acquire the Subject Property prior to the filing of an award by the Court appointed commissioners, pursuant to Minn. Stat. § 1 I7.001 and § 1 I7.042; and WHEREAS, the City finds and declares that it is in the public interest to acquire title to and possession of the Subject Property prior to the filing of an award by the Court Appointed Commissioners). and I I I I I I I I I I I I I I I I I I
