I [I I I I I I I I I I I I I I I I I I WHEREAS, the property owner of the Subject has been identified by the City as follows: IPin 28-32-25-13-0001 FEE OWNER B.M.A. Associates, a Minnesota Partnership NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That in order to carry out the purposes and objectives described above it is necessary to acquire the Subject Property. That the acquisition of the Subject Property by exercise of eminent domain in the manner provided-by Minnesota Statute Chapter 117 serves a public interest and is deemed to be necessary. That the City deems it necessary for the reasons set forth above to proceed without delay under Minn. Stat. §117.042 to pay t6 the owners or into court a sum of money to serve as compensation to the owners of the Subject Property, which amount shall be equal to Petitioner's approved appraisal of value as determined by the City. That the City Administrator is hereby directed to acquire the Subject Property as described above in accordance with Minnesota Statutes. The City Administrator is authorized to negotiate and represent the City of Ramsey in all proceedings. 5. That if the Subject Property cannot be acquired by direct negotiation, it shall be acquired by eminent domain. That the City Attorney is authorized to file the necessary petition therefore, and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the City or Court. 7. That the City Administrator is authorized to expend necessary funds for appraisals of the Subject Property.
