-06-

The proposed detached accessory building will be located in the rear yard approximately 60'
south of the principal dwelling. The proposed location exceeds the six (6) foot side yard and five
(5) foot rear yard setbacks established in the residential urban area. The Applicant is not
proposing to install a driveway to the detached building since the accessory building will be used
mainly for storage and not an active daily parking garage.

The Planning Commission held a public hearing on April 3, 2001. Subsequent to the Planning
Commission meeting Staff received a letter opposing the construction of Mr. Hansen's accessory
building. Ms. Sch/mmelman contacted Staff regarding the letter she submitted to the City,
during the conversation it became apparent to Staff that Mr. and Mrs. Schimmelman were
opposing construction of any accessory structure on Mr. Hansen's property and not the
conditional use permit request to exceed accessory building height. Staff explained that City
Code permits construction of accessory buildings on residential lots and Mr, Hansen was not
proposing to exceed the accessory building square footage standards.

Recommendation:

The Planning Commission recommended approval of Jeff Hansen's request for a conditional use
permit to exceed the accessory building heigl~t restriction established in City Code.

Council Action:

Motion to adopt Resolution #01-04-~~\ adopting Findings of Fact #__ relating to Jeff
Hansen's request for a conditional use permit to exceed the accessory building height restriction.

-and- . ~
Motion to adopt Resolution #01-04- ... approving Jeff Hansen's request to exceed
accessory building height restrictions based on the findings of fact, and adopt a resolution
declaring terms of same.

~or-

Motion to deny Jeff Hansen's request for a conditional use permit to exceed accessory building
height, based on the £mdings of fact.

Review Checklist:
Community Development Director
Principal Planner
City Attorney

CC: 04/24/01

I
!
!
I
I
I
I
I
I
I
I
I
I
I
I

I
I
I
