! <br />! <br /> <br />9.50.03 <br /> <br />Preliminary Plat <br /> <br /> Subdivision 1. Procedure. Prior to dividing any tract of land into <br />two or more lots or parcels of land, the following procedures shall be followed: <br /> <br />The subdivider shall file five copies of the preliminary plat w/th the <br />Zoning Administrator at least 30 calendar days before the next <br />regular monthly meeting of the planning commission at which <br />meeting said plat shall be considered and at which time the required <br />public hearing may be held. <br /> <br />At the time of the filing of the preliminary plat, the .subdivider shall <br />pay to the city such fees as shall be prescribed in a fee schedule <br />adopted by Council resolution: The foregoing fees shall be used to <br />defray the administration expense of the city in connection with the <br />review of said plat. City expense incurred in employing the services <br />of the city engineer, city ~orneys and other professional consultants <br />in connection with the review of said plat shall be reimbursed to the <br />city by the subdivider. <br /> <br />The Zoning Administrator shall refer copies of the preliminary plat <br />to the planning commission and one copy to the city engineer. <br /> <br />The ci:y engineer shall submit a report to the planning commission <br />.'before the public hearing, which shall deal with drainage, street and <br />other engineering matters pertinent to said preliminary plat. <br /> <br />The planning commission shall hold a public hearing on said <br />preliminary plat. Notice of public hearing shall be published in the <br />official newspaper of the city and sent to property owners within 350 <br />feet of the property to be subdivided at least ten days prior to the <br />hearing date. Public notice shall consist of a general description of <br />the proposal, the time, date and place of hearing. For the purpose of <br />notification, ownership of property within 350 feet shall be <br />determined by records on file in the city assessor's office. In case the <br />plat is disapproved, the subdivider shall be notified of the reason for <br />such action. The notices and publications as required hereunder <br />shall be done by the Zoning Administrator and shall be paid by the <br />subdivider. The planning commission shall conduct the hearing on <br />the preliminary plat and shall make its report to the Council at its <br />nex-r meeting which falls at least 14 days after the planning <br />commission's public hearing. It shall be the duty of the planning <br />commission to determine whether the preliminary plat conforms <br /> <br />! <br />! <br /> <br />·-230- <br /> <br /> <br />
