Jankowski, City Engineer

Background:

On May 10, 2001, a petition was received opposing Improvement Project #01-15, a bituminous
overlay of the Riverwood subdivision. The Council received, but did not accept, the petition on
May 22, 2001, directing that residents within the subdivision be informed of the City's policy
with regard to street maintenance projects. The attached letter of May 25, 2001, was mailed to
every property within Improvement Project #01 ~ 15.

There are 45 properties in Improvement Project #01-15. The petition opposing the project was
signed by 35 property owners. At the time of this writing, I have received twelve sig-natures of
withdrawal to the petition. If the majority of the benefited properties (23) remain opposed to the
project, it may not be ordered as an assessment project pursuant to the City Charter. Attached to
this case are (1) the list of benefited properties; (2) the petition opposing the project; and (3) the
signatures which have been withdrawn from the petition.

Conncil Action:

Motion to accept the petition along with any signature withdrawals or additions

and -

Motion to authorize Improvement Project #01-15, ii' possible

Reviewed by:

City Engineer Jankowski
City Attorney
Director of Public Works

CC: 06/12/01

-'~35-
