Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Kurak, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />Case #4: <br /> <br />Request to Rezone Certain Properties From R-1 Rural Residential to R-1 <br />Urban Residential; Case of Dave and Betty Pehlke <br /> <br />Community Development Director Frolik stated that David and Betty Pehlke are requesting to <br />plat fottr metes and bounds parcels into two, single-family urban residential lots, and an existing <br />homestead served with private well and septic system. The properties are within the MUSA, but <br />are currently zoned R-1 R:ural Residential. In order to plat urban lots, the proPerty must be zoned <br />R-1 Urban Residential. <br /> <br />City Administrator Norman stated that the City Council reviewed the rezoning request on <br />January 23, 2001. The Council referred the case to the Public Works Committee in order to <br />resolve a storm drainage easement issue that would cross the Pehlke property. During the Public <br />Works Comn-fittee, staff proposed a more comprehensive approach to the storm drainage issues <br />in the neighborhood as well as other infrastructure issues that would be affected by future <br />development. Staff worked closely with the Pehlkes and determined that more discussion would <br />be necessary prior to resolving all the issues in the neighborhood, however, it was further a~eed <br />that the rezoning and plat process should proceed. The Pehlkes have ageed to sign a Letter of <br />Understanding, which states that the Pehlkes will continue to negotiate with the City to allow a <br />water drainage easement on their property. <br /> <br />Councilmember Kurak stated that when other people subdivide their property there is a plan that <br />has to be submitted showing future roads and it appeared as if 152'~d could run on the northern <br />part of the Pehlke' property. She inquired if there would be future discussion regarding that <br />roadway. <br /> <br />City Administrator Norman replied yes, but since the Pehlkes are willing to work with the City <br />they did not want to hold back the building of the house. <br /> <br />Councilmember Kurak stated that she wanted to make sure that the issue is addressed. <br /> <br />Councilmember Anderson stated that the Letter of Understanding is unclear of what is being <br />offered. <br /> <br />City Attorney Goodrich replied that the Letter of Understanding would only be signed by the <br />Pehlkes and not something that the City would be committing to. <br /> <br />City Council/April 24, 2001 <br /> Page 15 of 27 <br /> <br />-25- <br /> <br /> <br />
