-26- <br /> <br />Councilmember Anderson inquired if there was an offer to be made or if offer had already been <br />made. <br /> <br />City Administrator Norman gave a brief overview of the discussions that have taken place to <br />date. <br /> <br />Councilmember Hendriksen suggested introducing the ordinance with the understanding that <br />staff resolve the issues prior to final adoption. <br /> <br />City Administrator Norman replied that they have been moving very quickly, but are in the early <br />stages of negotiation, lie stated that they will probably not have the issue resolved for a couple <br />of months. <br /> <br />Councilmember Kurak stated that she would like to avoid having to condemn property at a later <br />date for the future road. <br /> <br />Attorney representing the Pehlkes stated that the Pehlkes don't have any drainage problems, but <br />the surrounding area does and those are they issues they are trying to resolve. <br /> <br />City Engineer Otson noted that staffhas hired a plarming and engineering firm to look at the site. <br /> <br />Community Development Director Frolik stated that the proposed location for the house is a <br />separate lot of record and inquired if staff could issue a building permit without a rezoning. <br /> <br />City Attorney Goodrich replied yes. <br /> <br />Councitmember Hendfiksen stated that the problem with issuing the building permit is if they <br />would need to redraw lot lines, they might have issues with the mortgage company releasing <br />property. He inquired if it was possible to draft a better letter of understanding that would be <br />legally binding and identi¢ what the Pehlkes and the City are going to do in specific terms. <br /> <br />City Attorney Goodrich noted that the City would not be signing the Letter of Understanding. <br /> <br />Councilmember Hendriksen replied that if the Pehlkes are going to si~ the letter then they <br />would be legally bound to something. <br /> <br />City Attorney Goodrich stated that a better document could be drafted, but he was not sure it <br />could be done in the time frame they are looking for. <br /> <br />Councilmember Kurak stated that she was very uncomfortable with the Letter of Understanding. <br /> <br />Councilmember Hendriksen stated that he felt that they could introduce the ordinance, and then <br />prior to adopting the ordinance a more defined letter could be drafted. <br /> <br />City Council/April 24, 2001 <br />Page 16 of 2'7 <br /> <br />i <br />I <br />I <br />I' <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br /> <br /> <br />
