Upon completion of the Improvements to the <br />satisfaction of the City, any surplus balance remaining in the City's escrow account shall <br />be refunded to the DEVELOPER. <br /> <br />STORMWATER MANAGEMENT FEE. The CITY has enacted a Stormwater <br />Management Fee in the amount of Three Thousand Seven Hundred Forty One Dollars <br />($3,741.00) per commercial acre. The amount of Stormwater Management Fee due on <br />the Site is seven thousand seven hundred eighty one dollars ($7,781.00) (2.08 acres x <br />$3,741/acre). A cash payment will be required prior to the CITY releasing the Building <br />Permit. <br /> <br />FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of these <br />items on the Site shall be as directed by the City's Fire Chief. <br /> <br />LIGHTING. Any lighting installed on the structure or in the parking lot is subject to the <br />prior approval of the City Engineer and shall be designed so as to deflect light away from <br />all adjacent parcels. Bulbs emitting in excess of 3,000 lumens (150 watts) shall be so <br />directed that the bulb is not visible from off of the property where such light source is' <br />located <br /> <br />BUILDING FACADE. The Permittee agrees to construct the building exteriors with <br />integrally treated concrete block in accordance with the Exterior Elevations prepared by <br />Lampert Architects dated June 5, 2001. <br /> <br />REQUIREMENTS FOR BUILDING PERMIT AND CERTIFICATE OF <br />OCCUPANCY. No building permit for the Site will be issued until the permit-tee has: a) <br />signed and returned this Development Permit; b) provided the required cash payment for <br />stormwater management in accordance with Item #7 of this Permit; c) provided the <br />required financial guarantee in accordance with Item #13 of this Permit; and d) provided <br />the required cash deposit for inspection fees in accordance with Item #6 of this Permit; e) <br />provided the City with a copy of the Grading and Drainage Permit issued by the Lower <br />Rum River Water Management Organization. No Certificate of Occupancy for the <br />structure will be issued until: a) the Required Improvements are' accepted by the City; <br />and b) the landscaping maintenance guarantee has been provided in accordance with <br />Item # 13 of this Development Permit. <br /> <br />IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements <br />shall be completed before June 30, 2002. <br /> <br />ESCROW FOR REQUIRED IMPROVEMENTS. In order to ensure the installation <br />of the Required Improvements in accordance with City specifications and in a timely <br />manner, the Permittee shall be required to deposit with the City a cash escrow or letter of <br />credit, approved as to form by the City, in the amount of two hundred ninety two <br />thousand four hundred sixty three dollars ($292,463.00) which is 150% of the City's <br />estimated cost of the Improvements.
