CASE #: q

REQUEST FOR PRELIMINARY PLAT (P.U.D. SITE PLAN) OF THE PONDS
CASE OF ROYAL OAKS REALTY
By: Principal Planner Patrick Trudgeon

Background:

Royal Oaks Realty has submitted a preliminary plat (P.U.D. site plan) showing the development
of 86.71 acres at the corner of Dysprosium St. and Nowthen Boulevard. Royal Oaks Realty is
proposing to develop 73 single-family lots, 152 townhome units and 82 apartment units on this
property. The property was removed from the development moratorium on February 16, 2001.

The following items are enclosed:

a) Site location map
b) Preliminary Plat dated May 15, 2001
c) Planning Commission Minutes Dated March 6, 2001
d) Draft Planning Commission Minutes Dated June 5, 2001.
e) Traffic Generation Analysis prepared by SRF Consulting dated May 31, 2001
f) Information regarding the location and size of a house on Lot 2, Block 1
g) Letter from area residents regarding proposed subdivision
h) Letter from Tom Hovey, Minnesota DNR regarding proposed subdivision
i) City Staff Review Letter dated June 1, 2001, revised June 21, 2001

Notification:

Property owners located within 700 feet were notified of the proposed preliminary plat. State
law requires that the City notify property owners within 350' of the subject property.

Observations:

As part of this plat, the applicant is also asking to rezone the property to Planned Unit
Development (P.U.D.), to receive a variance from the height restrictions for the proposed
apartment building, and site plan approvals of the townhouse development and apartment
building.

The property is currently zoned R-I, Single Family and B-I, Business. As mentioned above, the
applicant is asking for a rezoning of the property to P.U.D. The March 2001 Draft
Comprehensive Plan shows a total of approximately 7.52 acres of this property being High
Density Residential, 13.52 acres being Medium Density Residential and 65.67 acres as Low
Density Residential. The following table indicates how much of each type of density is allowed
on the development property as directed by the March 2001 Draft Comprehensive Plan.

_ ~243-
