-26- <br /> <br />City Attorney Goodrich suggested tabling action, which would allow the Council time to view <br />the property and also give him the opportunity of discuss the legal ramifications on the purchase <br />agreement. <br /> <br />Councilmember Hendriksen stated that it is clear that St. Paul Terrninals does not want the <br />existing conditional use permit and the City does not want the current use of the property to <br />continue. He stated that he would be willing to grant some type of conditional use permit in <br />exchange for an improved site. <br /> <br />City Attorney Goodrich noted that the only purpose the conditional use permit would need to be <br />reassigned was for purchase agreement purposes. Reassigning the conditional use permit does <br />not put the City in a different position than what currently exists. <br /> <br />Jim Gilbertson, 17930 ???, Ramsey, inquired as to what the City was negotiating with Danny's <br />Trarmy and why they are changing the rnles. The City should be taking in tax dollars rather than <br />giving land away. <br /> <br />Mr. Martinson replied that St. Paul Terminals is not asking the Council anything for free. They <br />are willing to comply with the terms of the conditional use permit as it is written. The City came <br />to St. Paul Terminals asking for some type of concessions regarding the extension of 141~t Street, <br />but without a conditional use permit they do not own the property. <br /> <br />Mayor Gamec suggested tabling action until the next City Council meeting. <br /> <br />Kristine Boline, Attorney representing Danny's Trannys, inquired if the Council would consider <br />an interim assignment of the conditional use permit so that the sale of the property could <br />continue. <br /> <br />Mayor Gamec recommending having all parties involved meet with the City Attorney to work <br />out the details. <br /> <br />Motion to by Councilmember Aa~derson, seconded by Councilmember Kurak, to table action <br />until the next regular City Council meeting. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Kurak, Hendriksen, <br />and Zinm~erman. Voting No: None. <br /> <br />Case #4: <br /> <br />Receive Quotes for the Removal of Concrete Rubble and Miscellaneous <br />Debris on Makens Property <br /> <br />City Engineer Olson stated that the condemnation of 143~d Avenue NW between Jasper Street <br />NW and C.R. #116 started early this spring and will continue and be completed by the end of the <br />summer.
