Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> RESOLUTION #01-06- <br /> <br />I <br />I <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # <br />FOR A CONDITIONAL USE PERMIT <br /> <br />RELATING TO A REQUEST <br /> <br /> WHEREAS, on May 23, 2001, St. Paul Terminals Metal Express, hereinafter referred to <br />as Applicant, has properly applied for a conditional use permit to operate a recycling and <br />processing facility for metals and landscape timbers on the property generally known as 14050 <br />Basalt Street N.W. and legally described as follows: <br /> <br />Lot 1 and Lot 2 (except the south 30 feet of Lot 2), Block 4, Gateway North Industrial <br />Park Plat 2, Anoka County, Minnesota. <br /> <br />I <br />I <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />. That the Applicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.04 of the Ramsey City Code on June 5, 2001, and that <br />said public hearing was properly advertised and that the minutes of said public hearing <br />are hereby incorporated by reference. <br /> <br />I <br />I <br />I <br /> <br />That the subject property is approximately 2.4 acres in size. <br /> <br />That the subject property is located in the Industrial District. <br /> <br />That the adjacent parcels to the north, east and south are also zoned Industrial and the <br />adjacent parcel to the west is zoned Business Warehouse and is occupied with an asphalt <br />production plant, a heavy industrial user, <br /> <br />That on April 25, 1989, the City of Ramsey issued a conditional use permit to Daniel <br />Karst to operate an aluminum processing facility on Lot 1, Block 4, Gateway North <br />Industrial park Plat 2. <br /> <br />That on November l 3, 1990, the City, Council approved an amendment to the Conditional <br />Use Permit to expand the use to include a second melt furnace. <br /> <br />That on March 9, 1993, the City Council approved an amendment to the Conditional Use <br />Permit to allow the disassembly of engines and transmissions as part of the preparation of <br />feedstock for the aluminum melt furnaces. <br /> <br />That the City records indicate a significant history of violations of the terms of the <br />conditional use permit while Daniel Karst was doing business as Danny's Aluminnum <br />Processing and Danny's Tranny's. <br /> <br />I <br />i <br />I <br />I <br />I <br />I' <br />I <br /> <br />-360- <br /> <br />t0. <br /> <br />1t. <br /> <br />12. <br /> <br />That in 1999, St. Paul Terminals assumed the responsibility of managing the facility and <br />entered into a lease/purchase option with Mr. Daniel Karst. <br /> <br />That since St. Paul Terminals commenced managing the facility, there has been a <br />significant impr6vement in the condition of premises. <br /> <br />That the City reassignment of the conditional use permit from Daniel Karst to St. Paul <br />Terminals is one of the criteria for the completion of the lease/purchase agreement. <br /> <br />That St. Paul Terminals approached the City Council on May 8, 2001, requesting the <br />reassignment of the conditional use permit and as of May 21, 2001, the facility is closed <br />to all activity until the City takes final action on the conditional use permi! application. <br /> <br />I <br />I <br />I <br />I <br /> <br /> <br />
