Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #01-06- I I A RESOLUTION ADOPTING FINDINGS OF FACT # FOR A CONDITIONAL USE PERMIT RELATING TO A REQUEST WHEREAS, on May 23, 2001, St. Paul Terminals Metal Express, hereinafter referred to as Applicant, has properly applied for a conditional use permit to operate a recycling and processing facility for metals and landscape timbers on the property generally known as 14050 Basalt Street N.W. and legally described as follows: Lot 1 and Lot 2 (except the south 30 feet of Lot 2), Block 4, Gateway North Industrial Park Plat 2, Anoka County, Minnesota. I I (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: . That the Applicant appeared before the Planning and Zoning Commission for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code on June 5, 2001, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. I I I That the subject property is approximately 2.4 acres in size. That the subject property is located in the Industrial District. That the adjacent parcels to the north, east and south are also zoned Industrial and the adjacent parcel to the west is zoned Business Warehouse and is occupied with an asphalt production plant, a heavy industrial user, That on April 25, 1989, the City of Ramsey issued a conditional use permit to Daniel Karst to operate an aluminum processing facility on Lot 1, Block 4, Gateway North Industrial park Plat 2. That on November l 3, 1990, the City, Council approved an amendment to the Conditional Use Permit to expand the use to include a second melt furnace. That on March 9, 1993, the City Council approved an amendment to the Conditional Use Permit to allow the disassembly of engines and transmissions as part of the preparation of feedstock for the aluminum melt furnaces. That the City records indicate a significant history of violations of the terms of the conditional use permit while Daniel Karst was doing business as Danny's Aluminnum Processing and Danny's Tranny's. I i I I I I' I -360- t0. 1t. 12. That in 1999, St. Paul Terminals assumed the responsibility of managing the facility and entered into a lease/purchase option with Mr. Daniel Karst. That since St. Paul Terminals commenced managing the facility, there has been a significant impr6vement in the condition of premises. That the City reassignment of the conditional use permit from Daniel Karst to St. Paul Terminals is one of the criteria for the completion of the lease/purchase agreement. That St. Paul Terminals approached the City Council on May 8, 2001, requesting the reassignment of the conditional use permit and as of May 21, 2001, the facility is closed to all activity until the City takes final action on the conditional use permi! application.
