-158- <br /> <br />Councilmember. <br />adoption: <br /> <br />introduced the following resolution and mo~ed for its <br /> <br /> RESOLUTION #01-06- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0 REGARDING THE <br />STATUS OF COMPLIANCE WITH THE CONDITIONAL' USE PERMIT <br />ISSUED TO 14050 BASALT STREET N.W. FOR AN ALUMINUM PROCESSING <br />FACILITY <br /> <br /> WHEREAS, Danny's Aluminum Processing, !nc., hereinafter referred to as <br />"Permit-tee", has a Conditional Use Permit (the "Permit") to recycle and process <br />aluminum and disassemble engines and transmissions on the property generally known as <br />14050 Basalt Street N.W. and legally described as follows: <br /> <br />Lot 1, Block 4, GateWay North Industrial Park Plat #2, Anoka County, <br />Minnesota. <br /> <br />(the '"Subject Property,") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as <br />follows: <br /> <br />That the Permittee received a Permit from the City on April 25, 1989 for an <br />aluminum processing facility (the ~' Facility"). <br /> <br />That the Permit was amended by the Ramsey City Council on November 13, <br />1990, to allow for the addition of a second melt furnace to the Facility. <br /> <br />That the Permit was amended by the Ramsey City Council on March 9, 1993 to <br />allow for the disassembly of engines and transmission at the Facility. <br /> <br />That in accordance with Section 9.03.04 (Conditional Use Permits) of the Ramsey <br />City Code, the City sent a letter to Mr. Daniel Karst, owner of Danny's Aluminum <br />Processing, Inc. , allocating thirty (30) days to rectify the six (6) alleged Permit <br />violations, as identified in the May 21, 2001 letter, herein incorporated by <br />reference and attached hereto. <br /> <br />That there continues to be outside storage activity on Lots 2, 3 and 4 of Block 4, <br />Gateway North Industrial Park Plat #2 and the Permit applies to Lot 1 only. <br /> <br />That the Facility fronts on Basalt Street N.V¢. and Condition #24 of the Permit <br />requires that the Permittee screen the aluminum processing facility from any <br />public street and that screening is to achieve 90% opacity. Portions of the Subject <br />Property fronting on Basalt Street have no screening and the screening which is in <br />place is considerably less than 90% opacity requirement. <br /> <br />That there continues to be outside storage of debris or materials not used in the <br />aluminum processing operation and inoperable vehicles, which is in conflict with <br />Item # 13 of the Permit. <br /> <br />That the City has not been provided with a current copy of a Water Quality Permit <br />to verify compliance with Item #23 of the Permit. <br /> <br />! <br />! <br /> <br /> <br />
