Councilmember Hendriksen stated that the moratorium should probably be extended through to <br />Puma Street as well as the section immediately south down to the fiver. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to introduce <br />an Ordinance to establish a moratorium on the development of certain parcels located in Section <br />29 of the City of Ramsey, Anoka County, Minnesota, with staff including parcels identified <br />during the meeting. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Kurak. Voting No: None. <br /> <br />Community Development Frolik noted that the Council should appoint who will sit on the PAC <br />and TAC committees. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Kurak, to appoint Principal <br />Planner Trudgeon to the PAC with Mayor Gamec and City Administrator Norman as alternates <br />and appoint City Engineer Olson to the TAC with Principal Planner Trudgeon as an alternate. <br />Motion carried. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Kurak, Hendriksen, <br />and Zimmerman. Voting No: None. <br /> <br />Case #4: <br /> <br />Introduce Ordinance for the Rezoning of the Reilley Estates Property in <br />Section 24 <br /> <br />City Attorney Goodrich stated that by a Peremptory Writ of Mandamus dated May 8, 2001, the <br />Anoka County District County has ordered the City to "... immediately rezone Plaintiff's <br />property from R-1R (rural residential) to R-1U (urban residential) in accordance with its 1995 <br />comprehensive plan and zoning map in accordance with Plaintiff's zoning applications filed in <br />November 1'998 and May 15, 2000." In compliance with that order, staff presented the required <br />zoning ordinance for adoption. Because of the Court Order, no other City procedural steps were <br />required. <br /> <br />Councilmember Hendriksen inquired if it was correct that the rezoning is a Court order and as a <br />City, they could have appealed the decision, but the majority of the Council chose not to do so. <br /> <br />City Attorney Goodrich replied that the appeal period has not passed, but noted that the City is <br />required to rezone the property. <br /> <br />Councilmember Hendriksen inquired if it was true that the majority of the Council was not <br />opposed to appeal the decision. <br /> <br />City Council/June 12, 2001 <br /> Page 5 of 19 <br /> <br />-61- <br /> <br /> <br />
