Exclusive Tobacco Stores shall post a notice prohibiting the entering of the store by persons under 18 years or age which notice shall be in plain view of the general public on the licensed premises. The notice shall be at least 81/2 inches by 11 inches in size. Section 6. PROHIBITED SALES, paragraph c. of Ordinance 98-02 is amended to read as follows: Co By means of self-service methods whereby the customer does not need to make verbal or written request to an employee of the licensed premises in order to receive the tobacco, tobacco product, or tobacco related device and whereby there is not a physical exchange of the tobacco, tobacco product, or tobacco related device between the licensee or the licensee's employee, and the customer, unless the sale is by means of a vending machine controlled y an electronic device by an employee of the business. This paragraph c. does not apply to Exclusive Tobacco Stores. Ordinance 98-02, Section 8, SELF SERVICE SALES is amended to read as follows: It shall be unlawful for a licensee Under this ordinance to allow the sale of tobacco, tobacco products, or tobacco related devices by any means where by the customer may have access to such items without having to request the item fi:om the licensee or the licensee's employee and whereby there is not a physical exchange of the tobacco, tobacco product, or the tobacco related device between the licensee or his or her clerk and the customer unless the sale is by means of a vending machine which is controlled by the licensee or his or her clerk. All tobacco, tobacco products, and tobacco related devices shall either be stored behind a counter or other area not freely accessible to customers, or in a case or other storage unit not lef~ open and accessible to the general public. Any retailer selling tobacco, tobacco products, or'tobacco related devices at the time this ordinance is adopted shall comply with this section within sixty days. This paragraph does not apply to Exclusix, e Tobacco Stores. Ordinance 98-02, Section 11. OTHER ILLEGAL ACTS is amended by the addition of Subd. 6. entitled Entering of Exclusive Tobacco Stores, which subdivision shall provide as follows: Subd. 6. Entering of Exclusive Tobacco Stores.. It is unlawfful for a person under 18 years to enter an Exclusive Tobacco Store for the purpose of purchasing tobacco or tobacco products. Notwithstanding paragraph a. above, a person 18, 19 or 20 years old may enter an Exclusive Tobacco Store to perform work for the -121-
