No occupancy permit shall be issued for any lot in the plat until: (a) vehicular access to the lot is provided including the installation of Class V material on all streets in the Plat; and (b) all utilities are in place, operational and accepted by the CITY. It is herein agreed that the house pads for Lots 2 and 4 of Block 1 and'Lots 11, 12, and 13 of Block 2 shall be sited on their respective lots at point where the lot width is at least 160 feet. It is also agreed herein that the following lots have critical slopes less than 2% and shall be required to provide the CITY with certificate of grading prior to issuance of certificate of occupancy verifying grades and elevations: Lots 19, 20, 21, 25, 26 and 27 of Block 1 and Lots 13, 15,. 16, 17, 18 of Block 2. IV. PARK DEDICATION Cash Payment. The Plat is located in the Lake Itasca Park District. Park Dedication shall be satisfied by the DEVELOPER making a cash payment in the amount of Five Hundred per lot or Twenty Two Thousand Dollars and no/cents ($22,000.00), which is in accordance with the North_fork Park Dedication Agreement dated May 9, 1989. V GENERAL Tree Preservation and Planting Plan. In accordance with City Code and the policy established by the City of Ramsey Park and Recreation Commission on June 10, 1993, the DEVELOPER is required to submit a Landscape Plan for CITY approval that identifies existing tree growth within the Plat that will be preserved during construction and new plantings. It is herein agreed that the requirement for a Landscape Plan shall be fulfilled by the DEVELOPER as follows: a)¸ Minimizing the impact of construction on trees in accordance with Minnesota Extension Service publication "Protecting Trees From Construction Damage" (Publication #NR-FO-6135-S). b) Planting one two-inch diameter tree (or equivalent thereof) of a approved species at the road frontage or in the front yard of each of the lots in the Plat prior to the issuance of a Certificate of Occupancy. In the event the weather is not conducive to tree or sod planting at the time of Certificate of Occupancy, the Building Permitholder shall place a cash deposit in the amount of $200.00 for trees in an escrow account with the CITY and upon verification of the planting being accomplished, said cash deposit shall be refunded to the Building Permit holder. Failure of the Builder to comply with the planting requirement within a reasonable time frame following a determination by the CITY that weather conditions are conducive to planting shall give the CITY the' authority to cause the planting, the cost of which shall be charged to the escrow account and the Building shall not be eligible for a refund of the cash deposit made for this purpose. -163-
