Case <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT <br />TO DISPLAY AN ADVERTISING SIGN IN A RESIDENTIAL DISTRICT; <br />CASE OF TIMOTHY BERGERSEN <br /> By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />Timothy Bergersen has applied for a conditional use permit to display an advertising sign in a <br />residential district on the property located at 6211 167th Avenue. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site Location Map <br />b) Sign Plan <br />c) Site Pictures <br />d) Draft Planning Commission meeting minutes dated August 7, 2001 <br />e) Letter of support from Annette Herdzina <br />5) Proposed Findings of Fact <br />g) Proposed Conditional Use Permit <br /> <br />Notification: <br /> <br />In accordance with State law, City Staff attempted to notify all owners of property within 350 <br />feet of the boundaries of Mr. Bergersen's property, of the request for a conditional use permit <br />and the public hearing date. <br /> <br />Observations: <br /> <br />Mr. Bergersen is self-employed and has a landscaping business. He parks his commercial <br />vehicles and equipment at his residence (6211 167th Avenue N.W.). He does comply with the <br />requirement to have his commercial vehicles and equipment stored indoors or in an area that <br />screens the equipment to a degree of 75% from the public road and adjacent properties. <br /> <br />However, Mr. Bergersen also desires to advertise his business and erected 32 square foot sign at <br />the entrance to his property. Mr. Bergersen's property is approximately 14 acres in size and is <br />zoned R-1 Rural Residential. City Code does not contain provisions for advertising signs in <br />residential districts. The sign was brought to the attention of City Staff and Mr. Bergersen was <br />advised to remove, the sign or attempt to obtain a conditional use permit for the continued use of <br />the sign. <br /> <br />Mr. Bergersen's property is located on a Municipal State Aid road. There is a church west of his <br />property and there is a commercial district a short distance to the east. The sign is professionally <br />done with substantial landscaping improvements around it. <br /> <br />-303- <br /> <br /> <br />
