Community Development Director Frolik responded he would not because it is considered <br />unlawful non-conforming. <br /> <br />Mr. Menard stated when he built this pole bull,ding, he built it with the City Inspector's full <br />knowledge of the intended use. <br /> <br />.~Acfii~g Chairperson Nixt asked if there are any other situations like this in the City. <br /> <br />Community. Development Director Frolik responded she knows they have granted permits for <br />businesses out of garages before, but there is usually a home on the property. They have not <br />done this in the last ten years and the policy has been not to accept applications to run businesses <br />out of garages in residential districts. <br /> <br />City Engineer Jankowski arrived at 7:38 p.m. <br /> <br />Motion by Commissioner Wivoda, seconded by Commissioner Kociscak, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: ~ t~nmrperson Nixt, Commissioners Wivoda, Kociscak, <br />Dempsey, and Johnson. Voting No: None. Absent: Chairperson Anderson. <br /> <br />The public hearing closed at 7:38 p.m. <br /> <br /> Commission Business <br /> <br />-,a/c~m.g Chairperson NLxt called the regular meeting of the Planning Commission back to order at <br />7:38 p.m. <br /> <br />Mr. Menard stated he has signatures of everyone on his street that are not in opposition to what <br />he wants to do, with the exception some properties located south of Baugh Street. <br /> <br />Commissioner Johnson stated the current situation is this business has been operating illegally <br />for 15 years in the middle of a residential area. The Planning Commission is being asked to <br />legitimize it with conditions. There is a matter _o£whether the applicant will find the additional <br />controls acceptable and whether there is any significant objection to the increase of size to the <br />business by adjacent homeowners. <br /> <br />Mr. Barrett asked if he would be allowed to expand his"bUsiness at this site. <br /> <br />~ Chairperson Nixt informed the applicant in order to expand his bUSiness, he would have <br />to apply Ibr an amended Conditional' Use Permit. <br /> <br />Commissioner Johnson informed the applicant it would be very hard to expand a commercial use <br />in a residential area.
