Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION <br /> <br /> RESOLUTION #01-08-XXX <br />AGREEMENT TO PROVIDE AND <br /> <br />MAINTAIN LANDSCAPE <br /> <br />SCREENING ALONG T.H. #47 <br /> <br /> WHEREAS, a number of trees were removed along the east row of T.H. #47 as a part of <br />the highway project during the 2000 construction season; and <br /> <br /> WHEREAS, these trees had provided a significant screening barrier of the highway to <br />the adjacent residences; and <br /> <br /> WHEREAS, the City and the adjacent property owners find it mutually beneficial to <br />restore the lost screening with actual landscaping insofar as possible. <br /> <br />NOW THEREFORE, IT IS HEREBY AGREED AND UNDERSTOOD THAT, as follows: <br /> <br />1) That the City of Ramsey will cause the installation of plant material at no expense to the <br /> property owners. <br /> <br />2) The undersigned property owner will allow the installation of the planting on the owner's <br /> property, if necessary. <br /> <br />3) The undersigned property owner agrees to maintain the planting through watering and agrees <br /> to leave in place the planted material unless permission to remove has been obtained by the <br /> City. <br /> <br />4) The City will not replace trees, which do not survive. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> , and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br /> <br />
