I <br />I ~Centex' <br /> <br />Addition Development Agreement <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Park Dedication <br /> <br />Upon final platting of the first phase oft he 74.37 acre Addition, a total'of 2.9 acres {approximately} <br />of land will be dedicated for Woodland Green, Bear, and the unnamed Park at the North edge of the <br /> addition. This land dedication represents {approximately} 39% of the Park Dedication due. <br />The remaining dedication shall be met by Park Improvements equating to $135,000 m cash value, based <br />upon the 2001, $1700 per umt Park Dedication Fee. The City and the Developer, hereby agree to the <br />following prioritized improvements, and the process for implementation; <br /> <br />P_laye~uipment <br />A playstructure will be installed in Woodland Green. Park in the location of the ex/sting equipment no later <br />than 1 {one} year from the completion of the streets m the first phase. The Developer shall submit 3 <br />{three} different proposals for an installed playstrucmre, and associated appurtenances to the Parks and <br />Recreation Commission for approval for a project cost between $35,000 and $45,000 in value. The City <br />shall authorize the project and prepare a memorandum of understanding, detailing the various <br />responsibilities and costs to be deducted from the $135,000 in Park Dedication 'owed'. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Parkin~ Lot <br />Concurrent with the playground project, shall be a minimum of an 8 to 10 space, paved parking lot with <br />concrete curbing at the South side and center of Woodland Green Park_.The existing pave trail slmll link to <br />the parking area and be handicapped accessible. The parking' lot shall be connected by a temporary <br />bituminous drive to the existing 155t~ lane if the corresponding new road in the Addition is not <br />scheduled for construction within one year. The Developer shall submit spec/fications and a cost proposal <br />to the City, for a completion schedule no later than that of the playground. The City shall aTprove the <br />project by a memorandum acknowledging the value to be credited against the remaining Park Dedication <br />owed. <br /> <br />In addition to the above, the Developer agrees to grade and provide for turf establishmem for the new <br />parkland to be dedicated. This also will be a Stage 1 improvement with the first phase. The City hereby <br />agrees to provide credit for any re-grading of existing parkland - beyond that necessary to facilitate <br />blending of the topography of the newly dedicated parcels. <br /> <br />If the improvements above are completed before any new lots receive Final Plat approval, {that are not in <br />the first phase}, and the cost of these improvements exceed the amount ordinarily due for the first phase - <br />Park Dedication shall be considered satisfied at the current per mt fee using the following equation: <br />'Overage' divided by $].700 = number of future lots that shall be considered 'exempt' from Park <br />Dedication. This formula would be used if the City requires a later cash Park Dedication payment m lieu <br />of any park improvements or, if the Park Dedication rote is higher at the time of Final Plat approval for <br />subsequent phases of the ~Additiom <br /> <br />Concurrent with the applicable phase, both Woodland Greeh and Bear parks will have 6 {six} inch water <br />services available. Woodland Green shall also have a sewer service stubbed out. These utility services will <br />be provided at no cost to the City. <br /> <br />Also concurrent with any construction adjacent to the three park ~ites, the Developer will pave the park <br />trail links or concrete sidewalk connections to the subdivision's sidewalks. <br /> <br />I <br /> <br />-165- <br /> <br /> <br />
