Goodrich, City Attorney Background: At its May 8, 2001 meeting, the Council introduced an ordinance to permit the sale of the City owned property at the intersection of T.H. 47 and the newly constructed Sunwood Drive extension. This is approximately 11.2 acres, which is the subject of the February 18, 1999 purchase agreement between the City and ACCAP. Passage of this ordinance in consistent with the settlement agreement the council previously approved with regard to the law suit commenced by ACCAP on this subject. The sale ordinance may now be considered for final adoption. Enclosure: Sale ordinance Recommendation: Staff recommends adoption of the enclosed ordinance together with a motion to authorize the City Administrator and the Mayor to execute the necessary documents to close this transaction pursuant to the terms o£the February 18, 1999 purchase agreement. Council Action: Motion to adopt an ordinance authorizing the sale of the property legally described on attached Exhibit A which is an approximate 11.2 acre site sold to ACCAP pursuant to a February 18,1999 purchase agreement.AND Motion to authorize the Mayor and City Administrator to ~x°ecute the necessary legal documents to sell the real property legally described on attached Exhibit A pursuant to the terms of the February 18, 1999 purchase agreement between the City and ACCAP and the terms of the settlement agreement between the City and ACCAP relating to the Anoka County District Court law suit commenced by ACCAP to compel closing on the purchase agreement. -219-
