I <br />I <br />I <br />I <br />I <br />I <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />Access to Lots. There shall be a common access from Variolite Street N.W. for Lots <br />Lots 2 and 3, Block 1, McDonald Second Addition. At such time that the Subject <br />Property is further subdivided beyond the two lots contained in the Plat, construction of <br />streets interior to the Subject Property will be required and the DEVELOPERS agree to <br />abandon the access onto Variolite St. NW that will serve Lots 2 and 3, 'Block 1, <br />McDonald Second Addition. The driveway serving the aforementioned lots shall be <br />located in such a way to allow for the future subdivision of lots as generally shown in the <br />resubdivision plan dated August 24, 2001 and prepared by John Oliver and Associates. <br /> <br />Drainage and Utility Easements. The standard 10 foot (5 feet on common property <br />lines) drainage and utility easements shall be dedicated along the perimeter of each of the <br />two lots. In addition, all areas where wetlands are located shall be dedicated as drainage <br />and utility easements. <br /> <br />Resubdivisioa Restrictions. Under 4 in 40 density regulations, the Plat, based on the <br />underlying legal description, is limited to a total of four (4) lots and no further <br />resubdivision of any lot in the Plat will be permitted until sanitary sewer and municipal <br />water are available to the Subject Property or the repeal or reduction of the 4 in 40 <br />density restrictions. <br /> <br />II. <br />GENERAL <br /> <br />Park Dedication. The Plat is in the Trott Brook Park District. The DEVELOPER shall <br />satisfy the park dedication requirement for the Plat with a cash payment of two thousand <br />six hundred ($2,600). <br /> <br />Trail Development Fee. The City has enacted a trail development fee in the amount of <br />Three Hundred Twenty Five Dollars and no cents ($325.00) per lot. Lots 1 and 4, which <br />are existing homesteads, are exempt from this fee. Therefore, a payment for the two new <br />lots in the amount of Six Hundred Fifty Dollars and no cents ($650.00) shall be paid to <br />the City prior to releasing the Final Plat for recording. <br /> <br />Stormwater Management Fee. The CITY has enacted a Stormwater Management Fee <br />in the amount of Three Hundred Seventy Five Dollars and no cents ($375.00) per unit.. <br /> <br />-243- <br /> <br /> <br />
