-242- <br /> <br /> CITY OF RAMSEY <br /> ANOKA COUNTY, MINNESOTA <br />DEVELOPMENT AGREEMENT - MCDONALD SECOND ADDITION <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, <br />a municipal corporation of the State of Minnesota (the CITY"), and ROBERT H. AND <br />BARBARA A. MCDONALD AND WILLIAM P. AND JEANNETTE M. MAKOWSKY, <br />whose addresses are 16641 Variolite St. NW, Ramsey, MN 55303 and 16591 Variolite St. NW, <br />Ramsey, lVlN 55303, respectively, (the "DEVELOPERS"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPERS are the fee owner of the fo[lowing described property <br />situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally <br />described as follows: <br /> <br />Lots 1 and 2, McDonald Addition, Anoka County, Minnesota. <br /> <br />Or upon recording: <br /> <br />Lots 1, 2, 3 and 4, Block 1, McDonald Second Addition, Anoka County, Minnesota. <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, on September 25, 2001, pursuant to Resolution #01-09-__, the CITY <br />approved the final plat of the Subject Property which plat is known as MCDONALD SECOND <br />ADDITION (the "Plat") contingent on certain requirements, including DEVELOPERS and <br />CITY entering into this agreement; and <br /> <br />WHEREAS, the Plat consists of four (4) lots totaling approximately 43.60 acres; and <br /> <br /> WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05 (Subd. 1) entitled "Division or Consolidation of platted Lots". <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements have been fulfilled by the DEVELOPER. <br /> <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> I <br /> I <br /> I <br /> I <br /> ! <br /> ! <br /> <br /> <br />
