1 <br /> <br />CASE ti <br /> <br /> I <br /> <br /> I <br />:1 <br /> I <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO EXCEED ACCESSORY <br />STRUCTURE SQUARE FOOTAGE RESTRICTIONS; CASE OF BRADLEY WOLF <br />By: Megan Wald, Community Development Assistant <br /> <br />Background: <br /> <br />The City received an application from Bradley Wolf requesting a conditional use permit to <br />exceed the accessory structure square footage restrictions established in City Code on the <br />property located at 6421 Green Valley Road. The proposed use of the building is for agricultural <br />purposes. State Building Code exempts structures meeting the definition of agricultural building <br />from building permit requirements. However, this does not exempt agricultural buildings from <br />local zoning regulations such as setbacks, height, size, etc. The following items are enclosed for <br />your information: <br /> <br />I <br /> <br />I <br />I <br />I <br /> <br />a) Site location map <br />b) Site sketch <br />c) Draft Planning Commission meeting minutes dated September 10, 2001 <br />d) Proposed findings of fact <br />e) Proposed resolution to deny application for conditional use permit <br />f) Proposed conditional use permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public heating to property owners within 350 feet of the <br />subject property. <br /> <br />Observations: <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />The subject property is approximately 53 acres in size and is zoned R-1 Rural Residential. City <br />Code allows a maximum of 5,664 square feet of accessory structure space on parcels 10.6 acres <br />and greater in size. The applicant currently maintains 6,454 square feet of accessory structure <br />space on the subject property, which exceeds City Code restrictions by 790 square feet. <br /> <br />Mr. Wolf needs to replace an existing 38' x 65' (2,470 square feet) accessory structure because <br />the structure is deteriorating. Mr. Wolf would like to replace the existing accessory structure <br />with a 40'x 96' (3,840 square feet) accessory structure. The larger accessory structure is needed <br />to facilitate projected storage needs for Mr. Wolf's personal equipment and for the storage of <br />farm related materials and equipment by person's who rent farm land from Mr. Wolf. The <br />accessory structure would also serve as long term storage of agricultural items that are used for <br />Green Valley Green House's business (located across the street from the subject property). <br /> <br />-251- <br /> <br /> <br />
