City Attorney Goodrich presented the following additional findings of fact that should b~:adC~d~i :iiii: <br /> <br /> · That Minn. Stat. 473.858, 473.865, and 462.387 ali mandate that a city may n6t'adc~Pt zoning <br /> ordinance amendments, which are in conflict with the City's ComprehensivePlan. <br /> ·That interested residing near the subject property have filed a petition with',the City opPos/ng <br /> the rezoning request. The petition contains approximately 87 signatures; .~.~ <br /> · That at the public hearing held on this matter property owners:~residing'~near the <br /> property testified that the proposed rezoning would devalue:,; )their .prop~y, and create <br /> additional traffic through their neighborhood which is a conbem for:'~mall children in the <br /> neighborhood. <br /> <br /> Motion by Councilmember Hendriksen, seconded by:' Cbancilmember: Zimmerman, to adopt <br /> Resolution//01-08- adopting Findings of Fact #'~ .-'" "-rElating to a request to rezone Outlot <br /> A of Regency Pond fi.om Industrial to R-3 Urban Residential, as amended. <br /> <br /> Motion carried. Residential District; Case of Timothy Bergersen <br /> <br /> Community Development DireCtor Frglik..stated that Timothy Bergersen has applied for a <br /> conditional use perrrfit to display an advertising sign in a residential district on the property <br />~'~'ocated at 6211 167t~'.Avenue. Mr. Bergersen is self-employed and has a landscaping business. <br /> He parks his commercial~ vehiclesl and equipment at his residence (6211 167~h Avenue N.W.). He <br /> does comply With the requirement to have his commercial vehicles and equipment stored indoors <br /> or in an area.· that screens the equipment to a degree of 75% fi.om the public road and adjacent <br /> properties. HoWever, Mr, Bergersen also desires to advertise his business and erected 32 square <br /> foot sign at the entrance to his property. Mr. Bergersen's property is approximately 14 acres in <br /> size and is zoned R-I Rural Residential. City Code does not contain provisions for advertising <br /> signs in residential districts. The sign was brought to the attention of City Staff and Mr. <br /> Bergersen was advised to remove the sign or attempt to obtain a conditional use permit for the <br /> continued use of the sign. Mr. Bergersen's property is located on a Municipal State Aid road. <br /> There is a church west of his property and there is a commercial district a short distance to the <br /> east. The sign ~s professionally done with substantial landscaping ~mprovements around it.
