I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />CASE <br /> <br /> REQUEST FOR VACATION OF EASEMENTS; <br /> CASE OF TEC DESIGN AND <br />HOMESTEAD MULTI-FAMILY DEVELOPMENT CORPORATION <br />By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Earlier this year, Council approved the final plat for Orchard Hills, a townhome development. <br />The subdivision of Orchard Hills included a portion of Rademacher Addition and required a <br />rep[at of the area. This previously platted parcel in Rademacher Addition contained the standard <br />drainage and utility easements around the perimeter of the lot. Now the property has been <br />replatted as part of the Orchard Hills Development and Cobalt Street N.W. New drainage and <br />utility easements have been dedicated around the perimeter of all new lot lines. <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the subject property of the public hearing to vacate easements. <br /> <br />Observations: <br /> <br />It takes a public hearing and Council ordinance to eliminate the underlying drainage and utility <br />easements that existed as part of Rademacher Addition. The easements to be vacated are on the <br />former south and east property lines of Lot 1, Block 1, Rademacher Addition. The underlying <br />easement on the east property line now lies within the platted road right of way for the northerly <br />extension of Cobalt Street.
