CASE # <br /> <br /> REQUEST TO REZONE CERTAIN PROPERTY <br />FROM R-1 RURAL RESIDENTIAL TO R-1 URBAN RESIDENTIAL; <br />CASE OF OAKWOOD LAND DEVELOPMENT, INC. <br /> By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />On behalf of Jacob and Therese Barthold and Lee Kappedahl, Oakwood Land Development is <br />requesting a rezoning of property in Section 14 from R-1 Rural Residential to R-1 Urban <br />Residential to permit development of the subject property with single family residential lots <br />served by sanitary sewer and municipal water. The following items are enclosed for your <br />information: <br /> <br />a) Site location map <br />b) General development plan <br />c) Planning Commission public hearing and regular meeting minutes dated 9/10/01 <br />d) Proposed Findings of Fact <br />e) Proposed Ordinance <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to owners of property with/n 350 feet of <br />the subject property. Staff attempted to notify property owners within 700 feet of the subject <br />property of the request for rezoning and the public hearing held at the September Planning <br />Commission meeting. <br /> <br />Observations: <br /> <br />The property is approximately 9.7 acres in size. At Mr. Barthold's request, the subject property <br />was part of a Comprehensive Plan amendment initiated in 1993 by the City of Ramsey for a <br />MUSA boundary expansion. By the time the amendment was approved by Metro Council in <br />1995, a portion of Mr. Barthold's property, which is the subject of today's request, was not <br />included in the official MUSA boUndary expansion exhibit. The fact that this portion of Mr. <br />Barthold's property is not in the MUSA came to light during the preliminary plat review of <br />Apple Ridge (ensuing phases named River Pines) in 1997. The preliminary plat for Apple Ridge <br />was modified to eliminate this portion of Mr. Barthold's property. Therefore, the current <br />Comprehensive Plan retains this property for single family residential uses at rural standards. <br /> <br />The March 2001 Draft Comprehensive .Plan proposes to include the subject property in the <br />MUSA expansion area in order to complete the River Pines subdivisions. The fact that 158~ <br />Lane in River Pines 2~d Addition dead ends on the west boundary of the subject property is <br />problematic and presents a public safety concern since the length of this dead end is greater than <br />600 feet. In addition, a 66 foot wide dead end does not provide a sufficient amount of area for <br />the safe and efficient operation of municipal maintenance equipment, particularly snow plows. <br />Development of River Pines 5~ Addition will extend 158th Lane to the east and then intersect <br />with Lithium Street N.W., which is proposed to be extended from north boundary of Apple <br />Ridge to the north boundary of the proposed River Pines 5th. This street extension plan will <br />alleviate a major issue for the Public Works Department with respect to the current 158th dead- <br />end. <br /> <br />q <br /> <br />-105- <br /> <br /> <br />
