The acquisition of the Property by exercise of eminent domain in the manner provided by Minnesota Statute Chapter 117 serves a public interest and is deemed to be necessary. The City deems it necessary for the reasons set forth above to proceed without delay under Minn. Stat. §117.042 to pay to the owners or into court a sum of money to serve as compensation to the owner of the Property Interests, which amount shall be equal to Petitioner's approved appraisal of value as determined by the City. That the City Administrator is hereby directed to acquire the Property Interests as described above in accordance with Minnesota Statutes. The City Administrator is authorized to negotiate and represent the City of Ramsey in all proceedings. That if the Property Interests cannot be acquired by direct negotiation, they shall be acquired by eminent domain. That the City Council hereby authorizes acquisition of the Property Interests by eminent domain and to take title and possession of that land Prior to filing of an award by the Court Appointed Commissioners pursuant to Minn. Stat. §117.011 and §117.042. That the City Attorney is' authorized to file the necessary petition therefore, and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the City or Court. The City Administrator is authorized to expend necessary funds for appraisals of the Property Interests. The motion of the adoption of the foregoing resolution was duly seconded by Councilmember , and apon vote being taken thereon, the following in favor thereof: and the following voted against the same: and the following abstained: and the following were absent: whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this __ day of August 12, 2003. -255-
