The require,d dedication shall be made at time of final plat approval. <br /> <br />4 <br /> <br />The removal of trees, topsoil, storage of construction equipment, <br />burying of construction debris, or stockpiling of surplus soils is <br />strictly forbidden without the written approval of the Council. <br /> <br />Grading and utility plans, which may affect or impact the proposed <br />park dedication, shall be reviewed and approved by the City <br />Engineer prior to dedication, or at such time as is reasonably <br />determined. <br /> <br />To be eligible for park dedication credit, any land to be dedicated as <br />a requirement of this Section shall be useable, developable land <br />recreation purposes and shall be at a location convenient to the <br />people to be served. For purposes of park land dedication, wetlands <br />are not eligible. <br /> <br />The developer shall provide the City with a reproduction of the <br />certifidate of survey that shows all features as accepted on the final <br />grading plans. Such plan shall be received prior to 9.50.30 <br />maintenance guarantees. <br /> <br />Cash Payment. In lieu of land dedication, the Council may require the <br />subdivider to contribute a cash payment. The value of such payment shall <br />be the amount established by a fee schedule passed by City Council <br />resolution. <br /> <br />If, at the option of the council it is determined that a cash dedication shall <br />be made, the City shall allocate said cash contribution as follows: 50% of <br />the total cash contribution in the respective Recreation District "--'-_4 _.. _4 <br />50% in the Park Improvement Trust Fund. 9.50.30 <br /> <br />Combination of Land Dedication and Cash Payment. In. appropriate <br />plats, a combination of land and cash may be required by tlxe Council. In <br />the event a combination of land and cash is required, the amount of land to <br />be dedicated shall be credited against the total park dedication requirement <br />and the remaining cash contribution shall be based on the percent of the <br />remaining unfulfilled park dedication obligation. <br /> <br />Scenic and Conservation Easements. In appropriate plats, as determined <br />by agreement between the Council and the subdivider, the subdivider may <br />dedicate to the public a scenic easement in combination with the <br />requirements of §9.50.37 Subd. 2 and 3 above or, if the subdivider and <br />Council agree, the scenic and conservation easement dedication may be in <br />lieu of up to 25% of the requirements in this section. <br /> <br />9.50 Subdivision Regulations <br /> <br />9-33 March 2003 Draft <br /> <br />-411- <br /> <br /> <br />
